Quadriplegic given one day in jail and probation for fatal car wreck

Danny Espinoza, who was paralyzed  by the injuries he sustained in the 2006 accident that killed Dorothy Anne Walter, was sentenced Thursday to a single day in jail and five years probation for his role in the fatal crash.

Judge Michael Lewis also gave Espinoza a three-year suspended sentence, which means he could go to prison for a probation violation.

Espinoza pleaded no contest to felony vehicular manslaughter in Walter’s
death. 

During the hearing, Walter's family described her as a caring person and reminded the judge she was the victim in this case.

"I just hope the court understands what we can't express," Walter's grandson, Bryce Rankins said.

Espinoza's family said he is already a prisoner of his own body and that there would be inadequate medical care for him in prison.

Espinoza's father, Dennis, said he would die in prison.

"I would take his place in a second," Dennis Espinoza told the judge. "If you want to punish someone, punish me."

Espinoza, who now lives with his family in Ventura, was booked on Thursday and released later that day because he already spent his day in jail.

Ummmm.....so if he violates his probation he can be sent to prison? (I'm not wishing that, as I think his family should be taking care of him) But what could he possibly do to violate probation, seriously?

That's what I was thinking, Michele. What could he, as a quadriplegic, possibly do to get himself thrown in prison? Screwed up. I do wish he'd be thrown in prison. This whole thing is just wrong. It makes me angry.

That thats a load of bull crap, and they ask me why im so grumpy, lol. Basically yes, if you are injured while murdering someone you can get off. Whats wrong with our justice system, he should be thrown in jail, and hell if he dies too dam bad, he infact did kill someone, while he gets to live (and  play World of Warcraft I might add). oh well the whole thing i guess to reiterate, pisses me off

I am sorry but this person who is a prisoner of his own body still has the freedom to go to the park, disneyland even the beach. Something his victim will never experience again.

I worked in prison and it wouldn't be a death sentence. That is pure sensationalism. He would be just fine in prison and it would cost us money.

However, I understand the victim's family's frustration. It is like the judge basically said he didn't have to pay for what he did.

My question is since when do we care about a criminal's family's feelings? This whole, "Neither side will be happy" is a load of bull. If I had to choose whose side to make happy, I would choose the victim's.

He paid a stiff fine for it be becoming paralized, but there are tons of very productive handicaped people out there.  It could have been a little harsher of a sentance

well I think your all ............ You dont even know the guy, he is going to die ealier then any of you. She lived a great LONG life, Danny is young and with die sooner then later from his complications. (so you all can wait on that)Yeah he might be able to do things but he doesnt because he lives everyday in pain. So you might think everything in his life is all good but Im sure he wishes at times that he were just to die in that hospital. Danny is a good person too. He always thought and took care of others. He wanted to one day settle down and have children but thats not going to happen. He is suffering in the worst way possible. No one knows the whole story of what happened that night. If he were to come out of that wreck without being paralized then he would go to prision but he wold probably get out (sence this was his first offence in anything) in like 5-8 years for good behavior. I mean come on you all know that. He didnt mean to murder anyone.

This makes a mockery of our jucicial system.  Are we going to open the door to dozens of other prisoners who were "incapacitated" during the commision of their crimes.

First off I am shocked at timec, secondly I think he should have to pay behind bars. He murdered an innocent woman by street racing, I realize he paid a harsh penalty by being paralyzed but the reality is he lived and his paralysis was purely his fault and he deserves that sentence he put on himself. He should have to pay a sentence for what he did to the innocent victim, life behind bars.

this is not a fair sentance. a day in COUNTY JAIL what a slap in the face again for the family of the real victim. an article i read a few months ago said that he plays video games and chats on line with friends, yeah he sounds like a prisoner of his own body. this kinda thing just makes me mad. our judical system is a joke sometimes.

Oh...gee!  NOW the family of the murderer is asking for donations for their cost of the trial!!! 

 

AND they want to change the law????  He "lives with it every day"???  He "lives with it" while his MOTHER takes care of his guilty, weak-assed needs!!!  The family of his VICTIM never gets to even TOUCH THEIR OWN INNOCENT MOTHER!!!

mmh-

So if I kill an 80 year old it is ok since they lived a nice long life?  Faulty reasoning.

He killed this lady while he was breaking the law.  IN our society, we have consequneces that people pay. He is paralized due to his own stupidity.  The two are seperate.  He isn't paralized because he killed a woman.  He is paralized because of his own actions. 

It's hard to feel truely sorry for people when they are the own causes of thier own misfortune.

 this whole thing irritates me... i understand that the guy is NOW handicapped, but he wasnt at the time that he did this, he was being stupid, and now he is suffering for what he did, BUT, he should have more duties, serious what probation can he break being a quad? he KILLED a lady it doesnt matter if she was older (whos to say she wouldnt have lived to be 105?) or not, he killed someone doing a stupid act. People can recover from being handicapped, but you cant bring back someone that is dead. so if he heals are they going to have a second trial? i doubt it. 

 

I too would also like to see the article where they are asking for donations to cover their expenses.

as dannys family i would love to see that article too.and be informed on how were planning to ?change laws?? and ... tiffinilynn no you cant re attach a spinalcord.there is no recovery for him .there are so meny false alligations im reading its sad you all dont know the whole story and truth. for example there was NO street racing involved ,he was not driving with out head lights.

This is not the first time the family has sought funds from the public.  They had their hands out in September 2006 when the killer returned home from the hospital.  They will continue to seek pity from the public and raise funds in any way they can.  Hopefully people will realize that they are donating to a killer with self-inflicted injuries, and think twice about donating in the future.   

 

Danny Espinoza - Welcome Home

Here are some pictures from the fundraiser on 9/17/06 that took place at the Moose Lodge in Ventura, CA. The event was put together in an effort to help out one of our close friends, and an all around great guy, Danny Espinoza. Danny was involved in a near-fatal car accident earlier this year which left him in a wheelchair with very limited mobility. In the last six months he has undergone extensive medical treatment and has been active in physical therapy. The amount of progress he has made thus far just goes to show how strong and motivated a person he is, but the road to a full recovery will be a long one. Danny will now be living in Ventura with his family, who will be assisting him in his new goals to improve his health. As a direct result of these sudden expenses his family was able to raise nearly 15 thousand dollars at this fundraiser. It seemed like the entire community was involved in this event, and it was really special to see the kindness and generosity from several individuals and business that participated. I'd like to personally thank Danny's family for all the hard work that went into planning. Everything went off without a hitch. Those in attendance had a great time, but more importantly felt honored to be an active part of Danny's life. Here are some of the highlights from the day. Enjoy...

I  think he was referring to another case that happened July 4, 2008. But not sure that's why I asked for the link.

vadasmom-so, we've heard he wasn't street racing already, did someone mention it?  I think people are putting the high speed of 94mph and associating it with racing. Seriously, wouldn't you because there is really no need to drive that fast.

LUCIO...thank you for the article YOU shared!  YOU were RIGHT!!!  They begged "nearly fifteen thousand" at that rip-off!  I see, in the part you posted, that there was no mention of the MURDER he committed while having his "accident"!!!!  That $15,000 should go to his VICTIM'S FAMILY!!!

The judge definetly made the RIGHT decision. what he did is NOT considered a death sentence crime , those of you who say our state prison medical system is  good, google Nora Weber and do your home work du_ _  A _ _ _ _. This isnt about revenge or vindictivenes.Is it??? get a life . thank god the judge is smart enough to do the right thing, time to move on. All you who are talking crap have never been around a medically incapacited person so all i hear is blah blah blah out of your mouths. Friggen Bakersfield mentality  damn rednicks..  YES ITS ALL OVER, and THE CRYING begins.... oh yeah and the rumor and lies are also starting. your right after he came home from the hospital in september his family had a hard time paying far all his medical care and we had a fundraiser to help with the cost . and invited friends and family of danny people who know his charicter and love him .to particapate.but ...thats the only time now were capable of taking care of his needs.i dont see anything wrong with that. and.... hes not a murder  he has been charged with vehicular manslaughter with gross neglance not murder.  i think the judge did an awesome job if there is any a case for compassion this is it.

Lucio, the fundraisers and previous tickets for this dirt bag is really pissing me off.  Why didn't the Judge take the previous speeding tickets and his reckless disregard for the public safety into account on his decision?  Judge Lewis, you are an idiot!  Can the DA ask for another trial?

your right shes not comming back i wish i could change that and if i could magically heal danny i would and at that point prison wouldnt be a problim he would be able to walk away 4 or 6 years later and live his live but there are circumstances to everything . and yes he gets medical but ... that defenetly doesent pay for everything his family pays for the majority of his care .

The judge did the right thing...I would much rather be healthy in prison than not able to move at all on the streets. This man has suffered enough. I am glad KK finally made a fair decision.

I feel he has already been punished....

This is to the family and friends of Danny..

This is a very unfortunate accident but you will get through this. Do not allow the people on this blog to break your spirits. Take care of Danny and encourage Danny to move on with his life.  God forgives no matter what.....so that should be all the comfort you need.

YOU GUYS ARE ACTING LIKE THEY ADDED AN ADDITIONAL TAX  TO THE INTERNET TO SUPPORT DANNY. BAKERSFIELD....LEAVE THIS FAMILY ALONE. THEY ARE NOT THE ONES THAT KILLED THIS LADY. PEOPLE SPEED. DANNY MADE A STUPID DECISION TO SPEED AND HE ACCIDENTALLY KILLED SOMEONE...BUT HE HAS PAID FOR IT ALSO. I THINK HIS DISABILITY IS WORSE THAN 5 OR EVEN 10 YEARS IN PRISON...

What he did was wrong you are correct about it being an "accident" and just because "HE" caused his own paralysis does not make it "OK" for him not to serve a prison sentence for killing this lady. I have a question for you, do you remember Ryan Edwards who was out with his friends and they all got in an accident and two of the four young men involved were killed. That was an accident, they were close friends. Ryan is doing 13 years for killing 2 of his friends in an accident. If Ryan is doing 13 years shouldn't this guy have to do some time? Ryan was injured during the accident shouldn't he get some kind of leniency for that?

Just because he is paralyzed does not make it right that he has to do no time at all......!

not in jail .... i can go wherever i want, i can see my family all the time, go out to eat, enjoy nature

in jail .. paying for his crime by not enjoying all the things that this woman will never enjoy again

HaHa! I think the judge did the right thing here.. I am a RN at a state prison, and there is medical here but not good enough for dannys sake.. And if Danny was in this Prison, how could he defend himself from other prisoners??? I understand the Walters pain.But come on now.. MURDER??? I dont think that is what it should be called.. It was, at the wrong place at the wrong time. I do agree, he should not have been driving that fast. But at the time he was young, and young teenagers do that sort of thing.NO ONE SHOULD WISH DEATH UPON ANOTHER.. we all get judged in the end..

I am a friend of the family of one of the "friends"killed by Ryan Edwards. First off going out  that night did not make them friends. Second, Josh left behind a son, mother, stepfather, and many more. They  will never get over the loss of Josh. My friend had two sons. The first died of cancer, the second, Josh was killed in that accident. Tell them that Ryans punishment is too harsh. I think that it's not long enough. He will still be pretty young when he gets out...Josh is gone forever. Dorthey is gone forever.  Who knows how long she might have lived, that is not the factor in this.  She was loved and needed by her family and that was taken away by the bad choice of another. I figure I will be paying for Danny's medical care either way, I rather it be behind bars.

I have been on the fence with this one but when I read the post that this wasn't Danny's first time getting caught speeding, I finally made my decision.  If this was his 4th time getting "caught", I would have to say it was something he did quite frequently.  If he wasn't racing then what the hell was he doing driving 94 MPH??  To me, that's an accident waiting to happen.  You can't continue that type of behavior and get lucky all your life.  I think he should have been sentenced to prison for the same amount of time anyone else would have gotten.  He took a life and should be punished.  NO video games, NO visits from friends or family!!!  He should be treated like any other criminal in the system...visits on the weekends, even if he ended up in a medical facility for his time.

As far as the Ryan Edwards case, it's done and he's doing his time so let's not start splitting hairs about who was "friends" or not.
