OH boy............another law suit.

posted by GrizzlyCoach on Jul 18, 2008 at 04:30 PM

That sucks!

posted by Shwaine on Jul 18, 2008 at 04:36 PM

In this case witters, I would say a lawsuit would be justified. Regardless of how one spins it, the city worker was driving a motor vehicle into an area with limited visibility and killed someone in the process. An accident to be sure, but an accident caused by the worker's decision to drive where he couldn't see.

posted by dgrealish on Jul 18, 2008 at 05:52 PM

The family had already talked to an attorney prior to his death.  I can't say I blame them.

posted by vwilroy on Jul 18, 2008 at 06:15 PM

I agree with a lawsuit.  In most cases it is a joke but, we finally have one that is justified.

posted by murphyslaw on Jul 18, 2008 at 06:36 PM

No matter which way you weigh it out, the worker is wrong. You just don't back up to where you can not see, you get out and check or have some one to spot you.  He was dead wrong.  Law suit City.

Oh great, Rodrigez will be knocking at that family's door. Here go more of our tax dollers.

They talked with Chane Younger a few days ago.

Will the city worker now be charged with murder?

Time to make some sweeping changes to how these city trucks drive recklessly through the parks. Are you listening Diane Hoover?

posted by oldblue57 on Jul 18, 2008 at 08:35 PM

How about any intent? Malice or aforethought? This is a plain and simple accident. Of course if the decedant has alcohol or drugs maybe he rolled in front of the truck. Anyone ever been to Jefferson Park in the afternoon and see what a "shooting gallery" it is or I mean a lot potential customers for prop 36.

For all we know he was a homeless bum sleeping it off

posted by dgrealish on Jul 18, 2008 at 08:52 PM

In all the reporting done with regard to this tragic event, I have never heard that Mr. Morataya was a "homeless bum sleeping it off".  I've never heard a report of alcohol or drugs in his system.  I have asked if anyone had heard reports along these lines, but so far have got no response.  Unless it's confirmed, I feel it's wrong to continue to make these assumptions.

posted by LiveLoveLaugh on Jul 18, 2008 at 08:52 PM

Well whatever he was doing he didn't deserve to get ran over by a City truck.

GETALIFE:  Did you just come on here to take shots at people and then leave - could you be any more negative?

posted by getalife on Jul 18, 2008 at 09:00 PM

No I have a life outside of Bloging on a computer, I guess u don't

posted by getalife on Jul 18, 2008 at 09:03 PM

By the way why r u so compassionate to the man run over while sleeping in the park, but not to people killed by drunk drivers?

posted by dgrealish on Jul 18, 2008 at 09:05 PM

Real compassion has no boundaries.  I guess you didn't know that.

posted by getalife on Jul 18, 2008 at 09:07 PM

You must be one miserable person to be attacking the innocent the way you've done on these blogs today

posted by dgrealish on Jul 18, 2008 at 09:14 PM

Do you think getalife is tipping the bottle while blogging?  The comments are getting progressively incoherent.

posted by getalife on Jul 18, 2008 at 09:17 PM

I have a life, a J-O-B, and I don't blame the park worker who has to deal with people. Yea I agree that if he if fact  he was just a normal person taking a nap in the park, that would be a true accident. If the park worker was drinking that would make it a crime. If the guy was drinking it would be his fault.

posted by getalife on Jul 18, 2008 at 09:22 PM

By the way, how often do you take a nap in the park? Jefferson park?

posted by LiveLoveLaugh on Jul 18, 2008 at 09:22 PM

I think IT just had a drink and smoked a fatty  LMAO

So you are saying that if the guy was a "normal" person (what is a normal person these days).   YES you are on some kind of mind altering substance for sure.  Just make sure you don't hop in a car and drive!!!

posted by michele1075 on Jul 18, 2008 at 09:26 PM

Getalife NEEDS to go to bed!! (don't you love when new ones come on here to hassle people for a day or two and never return)

posted by getalife on Jul 18, 2008 at 09:30 PM

I, if I was drinking would know better than to do that. As for you,I hope that you don't take a nap in the park, because I wouldn't worry about getting run over. Maybe I would worry about all of the criminals that are out there? This isn't    exactly the safest city out there.

posted by dgrealish on Jul 18, 2008 at 09:32 PM

The day Mr. Morataya was ran over, it was VERY hot and the air quality was in the unhealthful range.  Knowing NOTHING about him, it's difficult to say why he was napping in Jefferson Park.  It is possible the park was in his neighborhood.  Perhaps he was taking a walk and the poor air quality got to him.  Maybe there were too many kids in the house making noise and he needed a quiet place to nap.  You see, we could sit here all night and come up with scenarios as to why he was napping in the park.  But I'll bet I could come up with more innocent reasons he was there than you could find criminal reasons he was there.  Isn't everyone innocent UNTIL proved guilty?  In this case, Mr. Morataya was a victim.  He has nothing to prove.

LLL, I think you're right about the fatty!

posted by getalife on Jul 18, 2008 at 09:42 PM

Oh And by the way, I have a real Job in the real world, so there for I do not smoke "fatty's" because I would like to keep my job. That's what mature people do. I guess you wouldn't know.

posted by dgrealish on Jul 18, 2008 at 09:46 PM

Cupcake, I had a real job, in the real world, I was able to retire on my investments at 42.  That was 10 years ago.  Please, I have kids older than you.

posted by getalife on Jul 18, 2008 at 09:48 PM

Good Go play golf and leave things up to people who have a clue. Do you really think you know how old I am?   Maybe you need to take a nap in the park.

posted by dgrealish on Jul 18, 2008 at 09:50 PM

Well, lets just say I have kids who are more mature than you, more compassionate than you and who don't spend as much time showing thier backsides as you.

posted by LiveLoveLaugh on Jul 18, 2008 at 09:52 PM

Oh And (lower case on and)

real Job (lower case again)

there for (therefore)

I think you might try some of the COLLAGE stuff....it's really good for you!!!!

OMG I've become OB   LMAO

Reyna, I don't know about Mr. Morataya, but I've known scores of people who deserved to have that happen to them. I mean, would it really bother anyone if Chad Vegas were squashed like a grape by a city truck?

posted by reyna805 on Jul 18, 2008 at 10:25 PM

JBS- You may be right. I can think of a few people I'd like to see under that truck.  I just don't like people jumping to conclusions.  It happens too much on these blogs and it isn't right.

posted by lanabuford on Jul 18, 2008 at 11:12 PM
Alot of things on these blogs isn't right! Thats what makes it fun.
posted by bakonative on Jul 18, 2008 at 11:56 PM

Ya know, I don't think we have ever heard what exactly the victim was doing other than sleeping. What if he was on his lunch hour, just kicking back in the park. People still do that on their lunch ya know??

posted by lanabuford on Jul 19, 2008 at 06:18 AM
honestly does it really matter what the guy was doing? It was a public park he had every right to be there. He died not because he was drunk or loaded on drugs but because the park worker who wasn't drunk or loaded on drugs RUN HIM OVER. whatever his reason for being there was, he didn't deserve the death penalty.
posted by cheeksmck on Jul 19, 2008 at 09:09 AM

Folks this was an accident. Plain and simple. The city worker will be held accountable. He was negligent but not intentionally so. Two lives ruined. Its a sad situation for everyone involved.

OMG! REALLY.........Glad this is all cleared up. Geezzzz!

JBS wrote: "I mean, would it really bother anyone if Chad Vegas were squashed like a grape by a city truck?"

Umm, nope, as long as there's no damage to the truck. That would be awful.

Get with the times Bako...back-up cameras...look into it. For the cost of the impending law suit, we probably could have equipped all city vehicles with back cameras, sensors and gold plated nuclear powered espresso machines. Get your wallet out guys.

posted by CatherineBaker on Jul 19, 2008 at 11:12 AM

H8cloz--your idea of preventative medicine is an excellent one.

This is yet another reason I'm glad I live outside of city limits. ; )
