In this case witters, I would say a lawsuit would be justified. Regardless of how one spins it, the city worker was driving a motor vehicle into an area with limited visibility and killed someone in the process. An accident to be sure, but an accident caused by the worker's decision to drive where he couldn't see. posted by

No matter which way you weigh it out, the worker is wrong. You just don't back up to where you can not see, you get out and check or have some one to spot you. He was dead wrong. Law suit City. posted by

How about any intent? Malice or aforethought? This is a plain and simple accident. Of course if the decedant has alcohol or drugs maybe he rolled in front of the truck. Anyone ever been to Jefferson Park in the afternoon and see what a "shooting gallery" it is or I mean a lot potential customers for prop 36. posted by

In all the reporting done with regard to this tragic event, I have never heard that Mr. Morataya was a "homeless bum sleeping it off". I've never heard a report of alcohol or drugs in his system. I have asked if anyone had heard reports along these lines, but so far have got no response. Unless it's confirmed, I feel it's wrong to continue to make these assumptions. posted by

I have a life, a J-O-B, and I don't blame the park worker who has to deal with people. Yea I agree that if he if fact he was just a normal person taking a nap in the park, that would be a true accident. If the park worker was drinking that would make it a crime. If the guy was drinking it would be his fault. posted by

I, if I was drinking would know better than to do that. As for you,I hope that you don't take a nap in the park, because I wouldn't worry about getting run over. Maybe I would worry about all of the criminals that are out there? This isn't exactly the safest city out there. posted by

The day Mr. Morataya was ran over, it was VERY hot and the air quality was in the unhealthful range. Knowing NOTHING about him, it's difficult to say why he was napping in Jefferson Park. It is possible the park was in his neighborhood. Perhaps he was taking a walk and the poor air quality got to him. Maybe there were too many kids in the house making noise and he needed a quiet place to nap. You see, we could sit here all night and come up with scenarios as to why he was napping in the park. But I'll bet I could come up with more innocent reasons he was there than you could find criminal reasons he was there. Isn't everyone innocent UNTIL proved guilty? In this case, Mr. Morataya was a victim. He has nothing to prove. LLL, I think you're right about the fatty! posted by

honestly does it really matter what the guy was doing? It was a public park he had every right to be there. He died not because he was drunk or loaded on drugs but because the park worker who wasn't drunk or loaded on drugs RUN HIM OVER. whatever his reason for being there was, he didn't deserve the death penalty.
