Three cited and seven arrested in roadside vending sweep

Roadside vendor enforcement results in arrests.

On Saturday, 07/19/2008, the Kern County Sheriff’s Office, Kern County Environmental Health Services Department and the Immigration and Customs Enforcement, (ICE), conducted an enforcement check of roadside vendors and mobile food vendors. These vendors are required to obtain county licenses prior to conducting business.

As a result of this enforcement action, three citations were issued and seven subjects were arrested. Many of the arrested subjects had been cited, multiple times, for the same offences in the past. In addition to the arrests, several hundred pounds of illegal food and produce were seized by Environmental Health Services.

During the enforcement action, an outdoor kitchen was located at 1117 Vista St, Bakersfield. This was located in the rear yard of a residence. This was a location where food was being prepared for street vendors. This uninspected and unlicensed outdoor kitchen posed a significant health risk. The food preparation and production process had no sanitation or protection from insects or animals. There was no refrigeration for the unused products, which were left on the ground for future use.

Environmental Health Services found the preparation method a health risk. The food products were being boiled in galvanized trash cans. The heat causes the galvanization to separate from the metal surfaces and adheres to the food. Once the food is ingested the zinc and other metals could cause heavy metal poising. At this time Environmental Health Services has not received any reports of illnesses associated with this kitchen. The operators of the kitchen were identified as Celia Hoyos Avilia, Hispanic female, 30 years old; Petra Baez, Hispanic Female, 23 years old; and Leticia Baez, Hispanic Female, 29 years old. All three were arrested for: Cooking and selling without a license, (CO 5.32.030) and No County Health Permit (CO 5.32.040). In addition Petra Baez was arrested for giving false information to a Peace Officer, (PC 148.9).

If you wish to report an illness resulting from consuming food from a street vendor, contact the Kern County Environmental Health Services Department at 862-8700.

Also arrested, were the following subjects:

Juan Suarez Perez, Hispanic Male, 37 years old, Vendor without a license (CO 5.090.101) and Possession of less than one ounce of Marijuana, (H&S11357b).

Juan Hernandez Garcia, Hispanic Male, 32 years old, Vendor without a license (CO 5.090.101).

Geronimo Winies, Hispanic Male, 22 years old, Vendor without a license (CO 5.090.101) and No County Health Permit (CO 5.32.040).


Juan Trinidad Santos, Hispanic Male, 31 years old, Vendor without a license (CO 5.090.101) and Operating a Business without permit (RT 6071).

And we are surprised because.....................?????

These people have been on the streets and going door to door for years. There are food vendors who take their wares into businesses - beauty shops in particular. As well as obtaining a county license, do they not have to have a health certificate or something from health services to be sure their food is prepared and kept safe for consumption???

What about all the vendors on street corners at all the holidays? I know they are selling non-edible items, but do they have a business license/permit? Are they accepting cash and not paying taxes?

 Hmmmm... So does this include the corn guy, who comes by on his bike every afternoon? Or the lady who comes by on the weekend selling hot tamales? And what about the guys with cotton candy hanging off a pole? Not to mention the people standing in front of stores selling peanut brittle, made from there kitchen? Oh wait the watermelon guy on the corner? Yeah, I thought so!

you must be around my area,  this guy pulls out the corn with his hands and kids buy it like candy, I've thought about running this jerk out of the neighborhood myself but, they'd find me breaking the law by doing so.

At least this guy could take a bath once or twice a week.  Area is in the location of Akers, between Ming and White Lane.

Vendor must think we have money because you see em going down the road every day and then!!!!! there's the Kerby vacuum guy, foot in door and me about to blow him away. I have signs I've bought and put out, one on the mail box and one by the front door.  They say they're not trying to sale me anything, that they are going to give me a free carpet shampoo,,,,,,,,,,,,,,,,,,,,,,,,

To bad bug spray doesn't work on them.  ;=)))

Grizzly:  these people ARE criminals! They are selling food products without a license, probably pay no taxes (like you and I) and a preparing food in an unsafe manner! THAT is criminal!!!  AND they are in all probability illegals!

I can see your point, but I'd rather have my law enfrocement officers citing child molestors or catching car theives, burglaries. Stuff that makes me have to pay higher insurance premuims. If people are dumb enough to eat off the cart then suffer the cosequences.

witter, I just looked at the arrest log for this past weekend, and they were also charged for being in the U.S. illegally.

And grizzly, what violations of the law do you recommend that the KC Environmental Health Services Dept. enforce? Traffic violations? Petty theft? Burglary? Check Fraud?

Or maybe the specific laws that focus on what they regulate?

What about the guys at Union and Ming selling parakeets?  Were those birds smuggled illegally, and possibly inhumanely, into the country?

Then there's the old food-vendor guy who works the area in front of Our Lady of Guadalupe church on California.  He's dirty-looking anyway, but I've seen him wipe his nose on the back of is hand, then stick his hand in the food.  EWWWWW YUCK!!!

i agree ... i used to like la rosa bars until i saw one of the la rosa guys peeing  in a park then went (without) washing his hands and sold some kids some la rosa bars. I used to like them too ... dang. to this day i still get the sweats when i hear those la rosa bike bells :(

Many of the arrested subjects had been cited, multiple times, for the same offences in the past.

A misdemeanor with two priors can be a felony; it would serve this bunch right to do time.

As far as I know, La Rosa is licensed and operates legally.  But those little La Rosa carts, I believe, are what spawned these "food vendor bicycle/pushcart" operations.

 The Roses show up @ White Lane And Wible, Ming Ave @ South Real, both places these dumb asses walk out into traffic and you can't go when the light changes because these dumb asses are making a blasted sale in front of you.  Makes me want to floor the gas and make em part of the black top.  If you honk the horn, the dumb ass thinks you want to buy Roses.  I think most of em are on dope.  I'm surprised they're not trying to make sales out in the middle of  HWY. 99. ;=))

Sorry Officer, I was distracted by the Roses and didn't see the fool standing in the traffic lane. LOL, LOL

Who knows, they could  sale dope with the corn dogs and the roses, years ago in this neighborhood, their was an ice cream man selling dope from the truck.

Think about it, could be going on right in front of you and you to not know it.  The Police should walk their Dogs around all of these businesses before they're ran off or ran in.

MMMM I love that corn, and the tamales from the lady at White Lane FoodsCo parking lot, some of the best I've had since grandma's passing..When I lived in McFarland, there used to be some old guy selling fresh cheese out of a rolling ice chest..wonder if anyone here does that...

WHO SAID ANYTHING ABOUT CORNDOGS MURPHY?
