Chivalry taken a step too far
Coming to the aid of a woman in need would usually be something to be commended. But there are limits. Two men who saw a woman being beaten with a stick by her ex-boyfriend in Oildale jumped in and saved her. But they used the same stick as they beat the ex-boyfriend unconscious, and now they're under arrest on suspicion of assault with a deadly weapon. Jerry Bogue, 38, the ex-boyfriend, is currently recovering at a local hospital. He'll be arrested on suspicion of assault with a deadly weapon and spousal abuse when he's better, according to deputies. Did Travis Martin and Anthony Gonzales, the men who beat Bogue, thereby saving the ex-girlfriend from further harm, cross the line? 100 comments from 40 users

They did what was right, but not what was legal. If the woman sues anyone, she should be put down, but not at the local pound. Anywhere in the vicinity of a dumpster will do. I used to be into that chivalry stuff. I gave it up the day after I moved to The Valley in July of 2000. posted by

Sounds like Oildale is the Bakersfield of Bakersfield. My brother got in a scrape like this once. Yep. It was at a bar and he saw one of his classmates knock his girlfriend to the ground then jump on her and start beating the crap out of her, so he came to her rescue. The beater then turned on my brother. Bad move. My "little" brother is 6'5" and weighs about 230 pounds. He had to protect himself so he knocked this guy silly. Fast forward one month. My brother was out bar hopping and standing outside a bar talking to people he knew when here comes the girlfriend beater up behind him - with an axe handle, and he clobbers my brother across the back of the head with it and knocked him cold. Years after this happened was when I found out about it and I asked my brother if he filed charges against the guy. Nope. My brother has a pretty hard head. After that happened he got a job in construction where they were building a domatory at Texas Women's University. It was seven stories and Bro was the guy installing concrete balconies outside each room. The got to the very last one, on the seventh floor and the crane DROPPED this two ton concrete balcony onto the scaffolding where my brother was standing. He fell SEVEN floors and landed on the safest place on his body - his head. He got up, dusted himself off and walked into the a building where they kept the heavy equipment and collapsed. He spent the next eleven months in physical therapy and got paid something like $80,000.00 aside from all the free medical care. I told him, "You with the hard head, knew exactly what you were doing, didn't you." He paid off his house with that money. posted by

In self defense, they always taught me, avoid a fight at all costs, but if you are forced to, then make sure you end it. I had a buddy who stopped a mugging utilizing submission techniques that did very little damage to his opponent. A minute later, the same guy comes back at him with a knife. Round two ended up a little different. The attacker ended up with a few broken bones, a dislocated shoulder, and was knocked unconscious when he was thrown back. My friend, however, ended up with a knife wound in his shoulder. Lesson learned. When people know they are beat, they will resort to desperate measures. I wonder what a guy who is capable of beating up a woman while threatening to kill her would do if given any opportunity to recover? Do you knock him semi-conscious, out of pity, and hope that you can escape with an injured woman in tow, crossing your fingers he doesn't go grab a gun and follow you. Or do you try to hold him down and trust he doesn't wiggle free and find a hidden weapon? Why give him the opportunity? Sad as it sounds, there are limits and our justice system does not advocate revenge nor retaliation. The guy got a good ass-whipping but what they did to him was nearly the same as what he did to her and therefore illegal. The guys should have practiced restraint and performed a citizens arrest. Thank God they were there to save her but unfortunately they allowed their own aggression to get them into trouble. posted by

I won't argue the law or even point out it is, after all, Oildale. That said public resources spent on jailing and prosecuting those two guys is public resources wasted. Was there criminal intent? As I see it Bogue got what he deserved and for most of us who are sick of crime and seeing the perps walk on technicalities it's a satisfying pleasure to see a bad person suffer the consequence of a bad act. Considering the circumstances only a moron would think they're doing something good to charge those guys with anything and stick them in a cell. Give 'em a verbal warning and let 'em go. Too many real criminals walk because there aren't enough resources to prosecute them and jail space to hold them.

I agree with avanti... any resources will be wasted, and it sounds like these guys have a pretty good defense. They were placed in an unusual and intense situation that required physical force. Unlike police, they presumably did not have restraint equipment on hand to keep the suspect under control. Another good restraint device is lack of consciousness. Obviously the whole story isn't out yet, but they didn't do any permanent damage, from what it sounds like, so I don't see how they went over the top. Now if they'd killed the guy after he was out, or did a severe amount of damage in some intentional way apart from that moment, it would be different. I wonder what he would have done to them if they had walked in and said "we hearby place you under citizen's arrest" posted by

Thanks for the update Michelle. They're being arrained today. I hope charges will be dropped as well. Anthony had turned his life around and was doing very well. After talking to his wife several times yesterday, I learned there was also a knife involved, which is why the stick was used. Just a case of taking a good deed too far IMHO posted by

Jerry is the one that had the knife correct? Now had these guys not intervene and this woman was beaten to death, people would be saying what kind of men were they to watch. Yes, Bogue had already slashed Sullivan at least once. I was just telling someone about this and they mentioned the same thing, it might make people think twice before getting involved. And that's really sad, in and of itself. Ms Sullivan is quite correct in her stating if it weren't for these two, she could very well be dead. posted by

Who knows how they would react if they came upon the scene of a woman beaten to unconsciousness while the beater continues to pummel her. Any man would be very ANGRY at the attacker. Maybe so angry they wanted to give him a dose of his own medicine. Maybe the attacker was hyped up on drugs or adrenalin and continued being combative with the rescuers.. Audrey - I tried to put myself in their shoes all day yesterday. I can say I'd have intervened as well. I'm a big guy and a haymaker to the temple has stopped many fights quickly. But with a knife and a stick involved, it may have been too dangerous to resort to fists. I think Anthony and Travis did the right thing. How can anyone respect some guy who pounds on a woman or a child -- anyone who's smaller? It's notable that these "big" guys don't pick on people bigger than they are. Why? There is a fine line between saving someone and vigilante justice. I can't say from the information that has been released if that line was crossed in this case, but that is probably the motivation for the arrests and investigation. The question that needs to be answered is did these guys just do what was needed to save the woman and prevent harm to themselves or did they cross the line into vigilantism and continued to beat the attacker after he was subdued. Right now, there's not enough information to answer that question. posted by

For all you whiners, consider this. Frequently the cops have to use force to subdue a suspect. That is allowed by law, just like what these two guys did. But when the cops use excessive force, they get fired and or charged with a crime. If these guys would have stopped once the guy was subdued, they would be fine. But they went overboard. I hope a lawyer in town offers to represent the two guys who got arrested for protecting the woman. The lawyer could argue that the men were acting in a heat of passion because they were so disturbed by the attack, which would probably reduce the charges. posted by

OB, Since the guy got knocked out, they clearly went overboard. I think the real question is, was he knocked out intentionaly? Did the good samaritans do it with malice? I dont think they did.
