Police officer arrested for alleged sexual battery while on duty

Thursday, July 16, 2009
 
 
On 6/28/09, the Bakersfield Police Department was contacted by an adult female
who reported she had been inappropriately touched by an on duty Bakersfield
Police officer on the previous day. The woman indicated she met the officer at a
loud party call he was dispatched to and he subsequently assaulted her. Based
on the information received from the woman, both a criminal and an internal
investigation were initiated. 
 
Upon concluding the criminal investigation it was submitted to the Kern County
District Attorney’s Office for a criminal complaint.
 
On 7/16/09, a warrant for misdemeanor battery and misdemeanor sexual battery
was issued for the arrest of the officer, who is identified as Jeffrey Luff.  
 
Officer Luff, who has been on administrative leave, was arrested on the warrant
this morning at 11:20 a.m., at the Bakersfield Police Department and booked into
the Kern County Jail.  His charges are as follows:
 
California Penal Code 243.4(e) (1) Any person who touches an intimate part of
another person, if the touching is against the will of the person touched, and is for
the specific purpose of sexual arousal, sexual gratification, or sexual abuse, is
guilty of misdemeanor sexual battery, punishable by a fine not exceeding two
thousand dollars ($2,000), or by imprisonment in a county jail not exceeding six
months, or by both that fine and imprisonment.
 
California Penal Code 243.  (a) A battery is punishable by a fine not exceeding
two thousand dollars ($2,000), or by imprisonment in a county jail not exceeding
six months, or by both that fine and imprisonment.
 
(A battery is any willful and unlawful use of force or violence upon the person of
another.)

More times than not, people fabricate a story to get a law enforement official in hot water.  Not sure if that is the case here? I'm also not sure if the DA issued the warrant to save political face or what. If this allegation is found to be true, what an idiot, and he just threw away a great career and retirement.

Great find vanity! People wonder why at times we question LE. This officer may well be one of the reasons. Committing crime "under color" is heinous.

No doubt about that, Sage. I support Law Enforcement 100% and appreciate what they do, but when they take advantage of their "authority" it really ticks me off.

The bad part about this is that she does not have to have proof of the incident. HER WORD is proof. Having been involved in a situation similar to this. The DA jumps to charge off of a verbal complaint. It's a scary place when all you have to do is report and an arrest will be made.

lsudduth:  The DA will NOT issue on a case where there is merely the word of one person against another person.  There must be additional corroborating evidence.  Before the DA will issue, the DA has to believe there is sufficient evidence to convince a jury of 12 beyond a reasonable doubt of the guilt of the accused.

If anyone saw the interview with Chief Rector than you know Luff has already been thrown under the bus. Innocent until proven guilty doesn't apply at the BPD. They did the same thing with officer Ryan Floyd involving sexual misconduct several years back. Nothing ever proven but terminated anyway. Luff made a poor decision by transporting two intoxicated females without having a partner with him. It will most likely cost him his job...

If I remember correctly there were three Duke lacrosse players accused of sexual assault who were later found innocent when all charges were dropped.  Let's put away the pitchforks and torches until this guy has had his day in court.

I know Jim, nice guy, but Jim, don't try and blame the young lady...  Real story is that he met one of his "friends" at the party, gave them a ride and at the end of the ride, the "friend" asked for a hug, after giving her a hug, the friend of the "friend" asked for a hug where he felt her up..... She reported it the next day and they nailed him on a pre text phone call...  where he ADMITTED what he did.. Guess he wasn't smart enough to realize that he could have been taped..  Also as far as Jim's blog.. Jeff released information to a group of people who DID NOT HAVE A NEED TO  KNOW!!!  Thats a CRIME in California... what an idiot...

A lot of people fall for the pre-text calls. A patrolman with 2 1/2 years on has probably never been involved in one. There was a kern county sheriff's sargent assigned to the detective division who was accused of child molestation. He fell for a pre-text call and admitted his crime. He is now serving a long prison term. If Luff did admitt guilt in the call he needs to resign, plead a good deal with the DA and get on with his life. Dragging it out will only prolong the pain for everyone involved including himself...

I used to respect BPD but no more. They acted on a false report and traumatized our family. I won't go into details but it was awful. Everything was dropped the next day due to further investigation. Mind you we have absolutely NO police record ever-not even a traffic ticket in 25+ years.  I will NEVER open the door for an officer of the law-that's an oxymoron-again. They had better have a search warrant in their hot little hands before they ever knock on my door again. My complaint against these detectives was dismissed and they got away with saying some very inappropriate things to me. We were guilty before a fair trial. Now even after many months my minor child still hides when someone knocks on the door because of how they handled this situation. I now have some idea of what police brutality is.

I'm so glad I'm gay.  A woman tried that bull with me when I was a student that I "felt her up" because we within inches of each while passing in a narrow walkway.  She complained, the campus police duly investigated.  I told them under no uncertain terms that my sexual orientation precluded an interest in her oversized bags of silicon.  They dropped the matter.  Apparently she had also accused another student in the same dorm of the same thing and unbeknownst to her he was gay too and knew one of the detectives.  She just had a fantasy of being the target of (gay) men's attention.  Fat whore.

I'll tell you guys, and no offense to many of you women, but you're just asking for it interacting with them.  You can't joke with them, you can't talk to them, you can't be near them or work with them because they will cry foul on the drop of a dime.  You can slap a guy on the ass, throw your arm around him in friendship, cuss at him when you're mad but if you so much as glance at a woman the "wrong way" or give her a hug SHE ASKED FOR she's crying bloody rape.  I'm sorry, but I feel bad for the officer and I hope he gets off the hook and learns from this experience.  I'd hate to see another member of law enforcement go down because of some dumb drunk slut and a public unsympathetic to crap these officers have to put up with babbysitting them on a daily basis.

Steve, your talking about the Lackey case.. that even shocked me... I worked around him for 10+ years.. That is who you are talking about right? As far as guilty until innocent at BPD, I agree with you on that, however in this particular case, this guy crossed the line in a big way...   

Billionaire... You hope this guy gets away... granted he gets his day in court, however to presume the female deserved it is really saying alot about your personality..

As much as it sounds harsh, BB has a good point.  Women do it all the time, for attention or some other reason. The same goes for domestic abuse. They cry foul when they are hit, but some fail to mention the thirty seven times they have whacked their significant other upside the head.

I didn't get the impression the BB is saying she deserved it. Its unfortunate that there are people out there in our society that cry wolf...and make it that much worse for a real victim to come forward and be believed. I think that's his point. 

I am not passing that judgement on this woman, or insinuating in any way that sexual assault or abuse is okay, I just hope she is telling the truth.

So we should all wait and see... instead of rushing to judgement based on blog comments and "friends of friends",

kcsdd, Yes Lackey is correct. I was in a lunch meeting with him  two days prior to his arrest. I too was shocked. As far as this Luff thing I am "out of the loop", so I will accept your assessment of the situation. The circumstances surrounding the alleged sexual battery are in themselves enough cause for termination, even if the actual crime had not occurred.

This guy pulled me over about a year go and was saying I was a thug and a drug dealer.  For the next few days he would drive by my folks house and smirk at me.  This guy thinks he's above the law.

I filed a report with internal affairs on this guy, too (thanks to OB56).  Maybe if people complain enough someone will listen.

a pre- text call   omg unbelievable, our law officers are just lying in wait. What is it? Do they feel threaten in public?  Our society does not even trust them anymore, Beaten, shot, abused, battery, sexual battery and of course it is all of us, and none of the LAW. My problem and it is a big one... is WHY should they be put on PAID Admin?, especially in our stressful economy? You just never know.......................

I guess I get annoyed when I'm accused of an activity that I know I am not even capable of - like oggling a woman.  Sorry, it ain't gonna happen.  If you wear clothes that allow your tits to fall out then yeah I'm gonna keep an eye on them because they are a danger should one of them fly out and hit me in the face, but don't think for a minute I'm getting pleasure out of seeing them and don't act coy as if you are trying to hide them with your low cut blouse. 

I once told my friend Audrey I didn't know why breasts appealed to straight men b/c they were just bags of fat.  The one time I even dared ... I almost puked.  I can't even look at nude female figures because I keep wondering, "where'd it go?"  If I can be accused of sexual harrassment when I have this innate revulsion, then God help the straight man.

BB, Thanks for sharing why women make you want to vomit~  SOME women can be scandalous I agree but not all women are like that and don't deserve to be disrespected by any man.   Its obvious this disgusting cop thought he could do whatever he wanted and get away with it.  it doesn't matter if she was drunk or wearing revealing clothes, hell she could have been naked and if she didn't give him permission to touch her then he had no RIGHT!

BB, some men are pretty disgusting too ,My daughter walked from her house to mine just over a block away and 3 guys were walking behind her saying things like 'hey sexy I lost my # can I have yours" and you sure are  fine"  So My boyfriend his friend and my son-in-law who aren't little guys, went and started walking behind these jerks repeating everything they had said to my daughter....These jerks started running..LOL couldn't take it when it was done to them.  hopefully they learned something.

Whether or not he groped the woman, what was he doing giving a drunk friend and her friend a ride home in the patrol car? I doubt that is part of standard procedure down at the department. Sounds a bit like misuse of taxpayer resources for personal purposes to me.

Hmmm...I am guessing the police department did a pretty thorough investigation of everyone involved in this thing. After all, it' is a black mark for them to have to go public with this. They are not going to arbitrarily toss an officer to the media, ergo the department to the media, without having their facts straight. Cops are people...we all make mistakes AND we all have to pay for those mistakes.

I think the victim of this offense must be a brave young woman. Would you want to walk into a police department and accuse a cop of lewd behavior? I think most of us would be too intimated to stand up for ourselves in a similar situation. I wish this officer no ill will, but if he does not have the common sense not to allow himself to be in a position that creates a mess like this, I don't want him "protecting" me and mine, regardless of the outcome of his trial.
