Prosecutor says driver will testify
Green said she found out the driver of the vehicle involved with the accident with the little boy. Green said she has the driver of the car. She said she just found him on Saturday. “I am uprooting this man’s life to get him to California.” He is prepared to testify on Friday afternoon. Green said she has many more rebuttal witnesses.

Green said she has 10 to 12 witnesses and certified copies of Kansas City Royals schedule. Green said she cannot fill Wednesday. Green said the only person from Ohio is the driver. Green said she will not bring the mother or the son.

Concern:  Hey People have you forgotten 5ive loved and loving people were brutally murdered for what!!!!!!!!!  They still have a loving family that loved them and will miss them for the rest  of their lives.  Yet and still Brothers' sat in a jail for 3hree years speaking no words not proclaiming his innocence but shoulda, coulda been searching through mountains and rivers for the killer who killed his family and loving mother-in-law.  But nooooooo he decide to get on the stand and incriminate himself numerously and fabricate stories of his where-abouts all over the United States, having  his so called good and truthful family give alibi's far far from believable. Yet it still remains a loving family lives were snuff out in seconds because of Selfishness and  Hatred !!!!!!!!   So far Brothers Dream Team Attorneys have not shown that their defendant is innocent beyond the reasonable doubt, but have shown he's hiding circumstances that's not adding up. So people go figure that.

Likely is the key word, not actual.

TO post #5 above.

This is not racial.  There are some decent, innocent black people dead.  Do you want to skip over a likely killer just because he's black.

The Race Card is not trump in this game.

It was supposed to have been posted to your "You can't veto the truth" blog, but somehow it ended up here.

I corrected it.

I was just replying to your comment above mine GrpThink.

Rude is ALWAYS graphic

That somehow got posted to the wrong blog.

Is the Californian web site screwing up on others beside myself? It's happened twice already.

But after a few meetings, he realized he could not afford Sala

I don't know what you call that, but it's not proof.

It should be no problem for you to provide a cite to your information since you seem to know all the minute, and seemingly private, details.

When Brother's returned to California after the murders, he was met at LAX by local Attorney Floyd. He met with Floyd a few times, but since Floyd does not do criminal defense work, he started meeting with Sala. But after a few meetings, he realized he could not afford Sala. That is when Kevin Little, from Fresno, stepped in.

but is being paid by the county, (taxpayers), as part of the indigent defendent program

The burden of proof is on you. Provide evidence that you know this as a fact.

Please try and know what you are talking about before you post here.

The jury is out on that for the time being. This may come back and bite you in the ass if you can't provide proof that he is being paid by the county.

While you're at it, provide proof of your claim Sala was Brothers' lawyer and was fired because he was too expensive.

GrpThink, you are wrong. Yes, Gardina is a private attorney, but is being paid by the county, (taxpayers), as part of the indigent defendent program. Please try and know what you are talking about before you post here.

He had local attorney H.A. Sala at first

Please provide proof of this. I searched everywhere and could not find one cite where Sala was ever Brothers' lawyer. The only mention of Sala in all the stories to date is where Sala is asked his opinion of how Gardina is doing in defending Brothers.

Whoops....Nice save GrpThink.

So us taxpayers are paying for those goofs Gardina and Bryan.

It is you who is misinformed.

Gardina is a private practice attorney hired by Brothers. He's not a public defender.

posted by jfrancais on May 1, 2007 at 12:24 PM
I think a lot of people who go to trial in KC don't even have the means to a Crappy Attorney let alone Sala. They start off with the "Goofs" and end up with the "Goofs".

If it was a federal case, I would not comment on this case.
posted by jfrancais on May 1, 2007 at 12:19 PM

So if you work for DOJ you know who can afford an attorney?

I think sinking to the depths of name calling was the focus of her comment, but okay I kant spel vury gud. Yu wen I luz.

JF, for someone who works for "DOJ", you seem to be rather misinformed about a lot of things in regards to this trial. If Brother's had money for a decent attorney, don't you think he would have hired one? He had local attorney H.A. Sala at first, but Sala is way to expensive for him. So us taxpayers are paying for those goofs Gardina and Bryan.

You are quick to judge others on their spelling, Meluvshoes, yet you let Jfrancais slide on his/her lack of punctuation and capitalization.  Hmmm....who's the biased one here?  This is getting rather catty, don't you think?

posted by jfrancais on May 1, 2007 at 08:22 AM
I think it should say, "misinformed misinformed pants on fire." I was not aware that Brothers' attorneys were paid for by taxpayers. I know he initially had some funds to commence his defense which is more than I can say for a majority of people who face the swift hand of KC Justice.

I think if you are going to sink to the depths of calling someone a "liar, liar, pants on fire" you should know how to spell liar!

He doesn't have any more money.  we tax payers are paying for his lawyers and experts.  I, for one, am not getting my money's worth!

Well if you have the stats I cant refute your position. I was basing my statement on the cases that have made news over the years. I am not convinced. however, that the Brothers case is racial.I don't think they want to just put a Black person in jail. I believe they want to put the blame on someone to proverbially "atone for the murder of the Harpers". Unfortunately, they have found someone who has money to fight the case and can afford experts to refute the accusations of the prosecution.

I think after the testimony on Friday by this other driver Brothers will look for a plea deal.

I believe that the DA inflicts his wrath on all creeds and colors equitably

You might want to look at the cases Jagels' office chooses to prosecute before making that statement.

I did, and he's not color blind by any means.
posted by jfrancais on Apr 30, 2007 at 06:51 PM
My sentiments exactly, GrpThink. "This town needs an enema...". I am in favor of regime change in the Kern County DA's office. Even though I have experienced racism in KC I am not so obtuse to think that this case is racial. I believe that the DA inflicts his wrath on all creeds and colors equitably. I truly hope and believe that things are changing for the better in good ol' Bakersfield but it appears to just be my wishful thinking...
posted by GrpThink on Apr 30, 2007 at 06:41 PM
I am anti-DA

Considering who the DA in this town is, that's a healthy attitude.

Jagel's office is as corrupt and dishonest as they come.
posted by jfrancais on Apr 30, 2007 at 06:16 PM
I am definitely anti-DA. I wouldn't say I am necessarilly  anti-law enforcement since I work in DOJ. I am also biased towards Brothers, however, I missed the part where I dismissed the witness before he testified.

Wouldn't you be sweating Bullets if you were  a black man on trial in Mississippi west?
posted by anonymous on Apr 30, 2007 at 05:38 PM
JF, I have to side with countyork here. By your previous posts, you are obviously anti-D.A., and  anti-law enforcement! Perhaps when Brother's goes to prison, you can go visit him and put money on his books.
posted by anonymous on Apr 30, 2007 at 05:37 PM
I guess Brothers is sweatin' bullets tonight.
posted by jfrancais on Apr 30, 2007 at 04:46 PM
What are you talking about? How can you make an unfounded accusation as such (KC justice rearing its ugly head, again)? I haven't "dismissed" anybody. I apologize if I have portrayed that.
posted by countyork on Apr 30, 2007 at 03:19 PM
Brothers said he was the driver.   If this guy is really the driver and not some crack-pot Green dug up than she might have her Perry Mason moment after all.    I'm on the prosecutors side on this case but unlike jfrancis who has already dismissed this man I am not prepared to render judgment on him until he testifies.
