Kern County Superior Court Judge Michael Bush relayed a message through his bailiff that open court session will not resume today. He said he will not address the media until tomorrow.

they don't call in jurors one by one if he was taking a plea deal. this sucks. how many more years do we have to watch this idiot go free for the most ridiculous reasons? if there is juror misconduct, can they press charges?

I agree something big happened in there today, but, it's been big everyday since this trail started. But, at least if they call a mistrial they can retry. Right???

  This is disgraceful.   To come so close and to now have the judge apparently about to declare a mistrial just as the case was finally set to go to deliberations is awful.   Brothers will almost certainly demand new attorneys and the attorneys will need at least a year to pour through all the evidence. NO NO NO!!!!!!    If some idiot jurors have screwed up months of work than they should be prosecuted to the fullest extent.   We're talking a waste of substantial taxpayer money, a waste of time for attorneys on both sides who spent months litigating this case,  and the defendant and the victims family both of whom were entitled to a verdict.   I hate this.   I hate this.   Tomorrow when the court convenes and announces that he has dismissed the jury and ended the trial, it will be a dark day in the administration of justice.   Imagine the hours and hours of work both in and out of court put in by both sides and both sides spending the weekend preparing their summations only to be told that all their work was for nothing.   I hope all jurors who caused this travesty be held accountable to the maximum amount for not following rules in a capitol case.   Absolutely disgusting and now even though I have no personal involvement in this trial, I still have to live with months of anxiety to see what the ultimate outcome will be.   I'm not going to get another good nights sleep for months now.   Thanks to a despicable jury.   My condolences to the victims family who thought they were going to have resolution one way or the other, and now have been victimized a second time by callous jurors.

I'm also angry at the judge.   Since he's just dismissed the jury and declared a mistrial there is no more reason to be secretive and wait to announce it to the public.   As soon as he declared the mistrial in chambers he should have come out and told the media that the trial is over.   As for retrying since the mistrial was not provoked by Green than yes there can be a retrial.   Since this remains a death case Brothers will still be held without bail, which I'm hoping will inspire Brothers to keep Gardina on and not waive his speedy trial rights, so they can begin the retrial in 90 days.

Maybe the trial is to important, and the judge just may want to make sure that they understand and if make sure they don't fear for their lives. Just a thought remember he still has 2 brother that were willing to lie for him.

There has been no mistrial. Nothing has been announced to the public about what went on behind those closed doors. All we know if the jurors were called into the courtroom.

To say that the jury has been "dismissed" is common terminology meaning they were allowed to go home for the remainder of the day.  It does NOT necessarily mean that the trial is over, that a mistrial has been called, or anything like that.  However, the jury will also be "dismissed" when the trial is over.

 

Be patient and let Judge Bush make his announcement tomorrow.  It may be that he is doing some quick research to guide him in making a decision regarding whatever today's incident involved.  Also, there are five alternates, and one of them could replace a current juror if a current juror was found to have violated his/her responsibilities regarding this trial.

 

Jeesh . . . some of you people watch too much TV.  Real world courtroom situations are virtually never like the drama of television.

I have no personal information but sending jurors home instead of continuing with closings reeks of mistrial to me.   The judge probably declared a mistrial because the press probably tainted the jury and is taking the night to prepare his reprimand of the media, and decide how to punish the reporters who tainted the jury.

my family is betting on a mistrial.  i think we're the only ones in KernCounty who didn't get summons-ed for jury duty for the trial.  ah well, we'll get it next time.

I looked at the jurors as they left and they had a look of relief on their faces. They are bound not to discuss this trial until the morning announcement.
