Mother of slain girl sues school district

The senseless murder of Jamesha Terry is most definitely one of life’s tragedies and the perpetrator should feel the full effect of justice for this heinous crime. That said for the family to sue the school district is wrong.

The argument that the bus driver was negligent is a stretch at best. To think for a minute enriching the family with a cash settlement would somehow correct anything is wrong. As much as we love our kids they are not a financial asset and their loss shouldn’t be turned into a chance at the “big spin.”

Society deserves better. First when these kind of things happen whether it’s ill behaved young people tormenting a caged animal or a trespassing youngster in an ornamental water fountain drowning himself these acts should not be translated into a financial cash cow for surviving relations. Nor can justice for Jamesha be served by giving her family and their attorney a big payoff.

Public money would be far better spent on public service than making a few individuals rich.

I'm not surprised that they're trying to cash in. Not at all.

Here's the story: http://www.bakersfield.com/...

Really, I'm not surprised either. Why not sue the uncle? I'll tell you because he probably has no money.  I don't understand why they think they can sue the school district because the girl got off one stop early.  This is truely sad and I feel for this childs mother for the loss she has endured but this lawsuit is not going to help. It is a far cry.

Well said avanti-champ.

This lawsuit has two chances of succeeding: None, and none.

Several times during my child's youth, she was injured because of the negligence of others.  I never once sued.  Granted, she didn't die, but she could have.  She still carries scars - physical & emotional - but we sued no one.  The physical injuries healed and the emotional ones are pretty much buried but raise their ugly heads now and again to be dealt with again. But, we sued no one.

In 1991, I was a passenger in a car that was rear ended and suffered severe back injury that I still live with.  I was told at one point that I would probably have to sue my best friend (who was driving, but stopped at a red light) to obtain a larger settlement!  I did not sue. My cat was killed by my neighbors pit bulls who were on the lose in the neighborhood. I did not sue.

So tell me again why in the world we have all these lawsuits day after day?  GREED.

I would not have sued but why not. The only way to wake up people these days are through their pockets. It is the schools responsibility that your child gets off at the correct bus stop. One day my kid didn't get on the bus and decided to walk....The bus driver called me at work before 8 am. So.... if you know my kid lives on Fruitvale would you would drop her off on Roberts Lane?

She was 14, not 5. Fourteen year olds do things like this and the bus driver has no power to stop them.

Outside of special ed students, the school has no obligation to bus our kids. It is done so they won't cross busy streets and be run over (and be sued).

But some people will try to line their pockets no matter what.

Amen to that brother

" I would not have sued but why not."  See, Timec, that is the attitude people have that causes all the law suits. Will law suits bring back the person? No. Will it change anything? Probably not.

I have not heard of many changes from a law suit wherein the parents sued (and got an out of court truckload of $$$) because their child was injured or killed because of something the child did to cause the event.  The boy that drowned in the Rabobank pound......what changed? Where are the parents and the $$$$ now?  The kid that drowned at the riverwalk (maybe there has been a couple). What changed? Where are the parents and the $$$$ now?

This teenager, who was murdered by a family member, may have asked the bus driver to drop her off at the place she disembarked. She may have even gone to the family members' house to visit. Suing the bus driver and ruining that persons life will not change the fact that a 14 year old possibly made a decision that cost her her life. Suing the school district will not even be a blip on their radar but the bus driver could be ruined, financially & emotionally for life. And for what???  a few bucks this mother will never see as you can bet a school bus driver in no way has 2 mill in their back pocket.

Some lawyer talked the family into playing this lottery.

Probably Larry H. Parker....

I agree with all of you.  The girl was 14 and old enough to make her own choices.  To blame the school is ridiculous.  How are they to blame.  This family needs to stop looking at the ads for new Cadillacs and Escalades.   The school districts are all going through budget cuts and there they are thinking they could put some money in the bank for themselves.  I would be real curious to know just what kind of lifestyle, employment and kids this family has.  I bet it is pretty ghetto.

Or Rodriguez......These attorneys are maggots!

It must be against the law to drop a child off at a different bus stop. Law suits are not cheap. This attorney is not going to file a federal suit against a school with nothing to base the suit on.

Witter,

No.... money is not going to bring this girl back but it will help with expenses. It will stop the school from breaking rules. It will help the mother take care of the rest of her children since her daughter was killed due to the schools negligence. This law suit might make the school open its eyes to other things they are doing wrong. I have zero respect for public schools. School officials are so out of control this day and age......Please don't get me started on schools.

vwilroy

You are a racist [edit]. Why does it matter what kind of lifestyle or employment this family has? They lost their daughter. So are you saying if they are ghetto then screw them. You people never cease (thanks JBS) to amaze me. You sound like HRC. It does not matter how this family lives. If the law suit is legit the courts will handle it....If this law suit is frivolous the courts will throw it out......real simple......Them being ghetto, uppity, white, or black has nothing to do with anything...

Note: I edited my own comment...
