Bakersfield man files suit over Sidekick debacle
An unidentified Bakersfield man is among Sidekick smartphone users suing Microsoft and T-Mobile over a recent outage that resulted in the loss of personal data. CNET reports "One suit, filed on behalf of a Bakersfield, Calif., man 'and all others similarly situated' " accuses the companies of negligence and false advertising. "That suit seeks monetary damages as well as an order requiring the companies to fix the Sidekicks and service or offer a full refund." As you might expect with such an inevitable story, there are some interesting reader comments being posted. 7 comments from 6 users

All phone numbers and addresses are maintained in my Rolodex, Chris, and pictures are in my photo albums. The Rolodex has worked well for decades. If it ain't broke, don't fix it! posted by

Moral to this story: never use a technological device that can't back up the data to another device and always run backups on the devices that can. posted by

A CNN story (www.cnn.com/2009/TECH/10/15/cnet.deaf.users.sidek ick.react/index.html) that links to the same CNET story states that the Sidekick is used by many deaf users, as a means of independence. Without this technology, they lose their independence and must rely on others. I'm not sure if the Bakersfield man filing the suit is deaf, but still, the loss of data experienced by Sidekick users could quite understandably be devastating.

This is another one of those lame law suit. I have been with t-mobile for many years and they provide you with maintaining all of your phone numbers with their eservices section. I recently changed phones and not all of my phone contacts were there so i called them and they assisted synchronizing my phone with eservice and I had all of my phone contacts again. If you loose a number, just wait if the person whose number you lost calls you add him again. Not rocket scientist stuff here folks. He is just a moron trying to get an easy buck. posted by
