The Planning Commission, Maggard, and conflicts

One of the arguments that's been used by people on the side of Ken Weir in the Planning Commission Conflagration of 2008 (Part One) has been that Russell Johnson works for Mike Maggard, and that's a conflict.

It's legally not a conflict of interest, but it does raise the question of smell test.

Mike Maggard is a public official, elected by many of the same people who elected Ken Weir. Maggard probably believes in all the same things Weir professes to believe in — planning standards such as property rights, responsible development, the security of a long-term plan, mom and apple pie. It seems the worst one can accuse Johnson of is reporting to Maggard, who reports to the voters.

And what about other officials who work for, well, other officials? Andy Stanley, a field rep for Kevin McCarthy now an employee of County Supervisor Ray Watson, was appointed to the planning commission just last year by Weir ally Zack Scrivner, who himself works for Jean Fuller. Is that a conflict?

Of course, while it may not be a conflict of interests, it may be a conflict of factions. Stanley, McCarthy, Scrivner, Fuller and Weir are all in the Thomas-Abernathy camp of the local Republicans, while Johnson and Maggard are in the Ashburn camp.

And then there are the other planning commissioners. Ted Blockley is an architect. Tom McGinnis is a real estate agent. Those seem pretty conflict-prone, but they're on the planning commission. And in fact, every planning commission I've ever covered has been staffed largely with professionals from the affected industries, because those are the people who have the interest and are willing to put in the time.

Hello James, I remember reading that Maggard appointed Jeff Flores, an Ashburn aide to the Kern County Planning Commission a few weeks back.  I do not think he has any planning experience.

Could be. I don't cover the county, so I don't know. But I doubt that Andy Stanley has much planning experience, or that Murray Tragish, a lawyer, has much planning experience. Both are on the Bakersfield Planning Commission.

It's not really the point of a planning commission, though. The important thing is to have smart people willing to put in the time. Politics being what it is, officials appoint their allies.

Its too bad we did not have someone with a Masters in Planning in charge of City/County Planning, not the Political folks.

I really like how you said "Politics being what it is, officials appoint their allies."  So, it's okay for Mike Maggard to appoint his ally to a planning commission, but not Ken Weir.  Is that coverage fair?

Had Ken weir appointed his ally in April 2009, it likely would have been an "in other action" item in the council story (depending on what else goes on that day), and even then only because it's rare (but not unprecedented) for the council to turn down an incumbent who reapplies for the job. Sullivan just reappointed her ally. Scrivner appointed his ally last April. How much coverage did they get?

But none of them wanted to remove a planning commissioner mid-term. That's what's unusual, and that's why it's news.

(Of course, now, even if Weir waits until Johnson's term expires, his appointment will get more than usual attention.)
