Doctor’s stroke, community’s tragedy

The shocking report of a Kern Medical Center surgeon being detained after a traffic accident and his medical care withheld demands a review of the Bakersfield Police Department’s training and procedures.


Inconsistencies between reports made by a nurse who arrived on the scene, by ambulance personnel that responded and by a police officer also require investigation.


According to the police report, officers were dispatched at 6:55 p.m. on Nov. 24 to an accident scene near the intersection of 24th and Oak streets. A Mercedes driven by neonatal surgeon Dr. Mohamad Harb had swerved off the road, coming to a stop on the sidewalk.


A witness reportedly kept Harb from leaving the scene. When police arrived, the 57-year-old doctor, who was dressed in his surgical scrubs, appeared to be disoriented and confused.


When an ambulance arrived, Harb’s vital signs and blood-sugar levels were checked and found to be normal. But because he had been placed in handcuffs, the ambulance crew reported they could not conduct a neurological exam.


A Hall emergency medical technician reported that a police officer administered two breath tests, which did not indicate Harb was under the influence of alcohol. According to the EMT, the officer canceled the ambulance, rather than having Harb taken to a hospital.


By happenstance, a registered nurse, who had just concluded working a shift at KMC with Harb, arrived at the intersection. Recognizing the doctor and alarmed by his appearance, she stopped.


The nurse identified herself. Although she could provide no information about Harb’s medical history, she reportedly asked if officers had called an ambulance.


“The female officer said, ‘One already came, but he’s going with us,’” the nurse recalled in a written statement.


Outraged, the nurse demanded  another ambulance be called and Harb taken to a hospital. The nurse noticed Harb’s pupils were “pinpoint and sluggish to react.” When the ambulance arrived, the doctor’s gait was unsteady and he was drooling as he walked to the gurney.


In a claim filed against the city — which is the first step in the filing of a lawsuit — Harb’s attorney alleges police caused permanent brain damage to Harb by restraining him, possibly hitting him on the head and negligently delaying treatment for a stroke by canceling the first ambulance crew that responded.


For patients experiencing symptoms of stroke, including slurred speech, confusion and loss of balance, the American Stroke Association Web site warns: “Call 911 immediately if you experience symptoms! Time lost is brain lost!”


Harb survived, but he is at home, where he is receiving nursing care and physical therapy.


This is a personal tragedy for Harb and his family. It is also a loss to the community of a critically needed medical resource. Harb cared for some of Kern’s most desperately ill babies.


But all of us must be concerned about law enforcement’s response to this incident and the failure to recognize a medical emergency.


Assistant Chief Bryan Lynn said the Bakersfield Police Department will review policies and training in the wake of Harb’s case. Police officers are required only to have first aid and CPR training.


Personnel with higher medical skills are dispatched to emergency scenes by other departments, Lynn said. Police officers are required to update their first aid training  every three years.


Clearly training needs to be increased and awareness raised to prevent future tragic mistakes.

In this town he was lucky the cops didn't shoot or taser him. I'm sure our police department will do a thorough investigation and exhonerate all involved. The city will be slapped with a million dollar plus judgement by an activist judge or jury. We'll pay for for it with increased property taxes while no infrasture ever gets worked on. Welcome to Stupidville, USA.

This is a more detailed account Michele.

This just confirms our cops have deep issues that need to be addressed. BPD do not care about the citizens of this community. They just want to make an arrest...period.

My uncle is a 20-plus year officer for the LAPD. When he comes up every couple of months with his family to visit, he has commented on the BPD's rep with the LAPD (which isn't glowing) - along the lines of stompin' cowboys with itchy trigger fingers. My brother is an officer in the Bay area, so don't get me wrong - I have the ULTIMATE respect for the officers' dedication and sacrifice... It's just ironic that the (some of) LAPD of all departments has comments against BPD.

I don't mean any disrespect to any officers or officers' families by this statement.

Agree with you britgal.  Our law enforcement is not concerned about what the condition of a person is, just shoot first and answer questions later.  I personally have a similar story in my family.  My father had very bad high blood pressure.  He was driving and started to lose consciousness.  Seemed that he took too much medicine and it drove his blood pressure way down, to the point that he fainted while driving.  Lucky for him, he did not harm himself or anyone else, as it was early in the morning.  But officers on the scene thought he was intoxicated and wanted to arrest him.  Someone who knew him at the scene told them his medical history and they called us, his family.  For my Dad it ended on a good note and he survived without any brain damage.   But I think to myself he could have been just like Dr. Harb.   I just think it is sad that poor innocent people are accused of crimes, when their only problem is maybe bad health.  

But like Adam's comments, I doubt that anything will ever be done to fix the real problem.  They will just sweep it under the carpet and of course exonerate the police officers involved.  They alway do an "investigation" of their own, but interestingly enough it always passes and they are the "good guys."  I have never yet seen anybody admit that they might be wrong -- even when they accused innocent people of molesting children way back in the 1980s.  I don't recall any kind of apology from DA's office.   But then again Ed Jagels would probably die rather than apologize to anybody -- OH Yeah.

Thanks to those of you who are smart enough to know that TBC has given us only one side of the story.

To the rest of you I say, "SHAME ON YOU".  How dare you sit home and judge honest, hardworking folks who put their lives on the line every day to keep our community safe.

I can't believe you do not have good enough sense to understand there is a hell of a lot more to this story than TBC has chosen to write about.

I dare any one of you to spend one week on the streets with BPD and listen to the lies and take the abuse they take from druggies, drunks, and criminals and not get a little bit immune to it.

You do not have the right to judge these folks!!  And may God help you if you think you are that important!

It would be very easy to be a cop for a week. Ride around harass a few people, refuse to seek medical attention for a Doctor having a stroke, arrest a few innocent and fewer guilty, lie in my report.......sounds easy to me.

This man was not a druggie, drunk, or criminal....he was a Dr. having a stroke and your law enforcement buddies that you are protecting did not have enough human decency or common sense to seek help.

Please read the entire story...TBC is going off police reports.....Lies that came directly from Payne's pen. They are going off of the ambulance drivers. The Bakersfield Californian are not in the business of publishing lies. Do you think if they were lying they would get away with it? I think not. 

Officer Payne if you are reading this can we hear your version...oh no I forgot you have to keep your lips sealed because you are about to cost the city 10 million dollars.

timec, do you REALLY think that any newspaper, even TBC, has never reported inaccurate information? Get real. TBC writes whatever sells newspapers.

And if one of your employees (even if you really have any), did something that caused you to be sued, would you want them talking to the media about it, or remaining silent until the issue was resolved by the attorneys?

So quit your nagging.

I know that newspapers report inaccurate info...but I don't think they would intentionally lie about this ...what do they have to gain. They are just reporting what they were told and what they have read in reports.

No I would not want my employees to talk about it that is why I said she has to keep her lips sealed......Mr.

I will not ever quit nagging I will go on and  on and on and on and on.......and on. Nagging is a talent OB.

No Missy I am very well informed......you are the one that is attempting the justify the actions of a cop that refused to seek medical attention for a dying doctor.

Who cares what they go through on a daily basis? It is called a job. If they don't enjoy dealing with druggies everyday...QUIT! I go through a lot also at my job...but this is how I feed my children so oh well....it still will not justify me doing wrong to others.

mom5mac, We better judge our police since the Constitution demands we do that. To do any different, is to abdicate the entire notion of self government, and mere notion it is rapidly becoming. The so-called "drug war" has distorted law enforcement into believing that just about every "citizen" is a "criminal". Unhappily mom, you lack any philosophy that would mitigate between the extremes of an out of control law enforcement scheme and simple humanity. Some clues are writ large.

They knew he was a doctor.

He was dressed as a doctor, just off the surgical floor.

He didn't have a whiff of alcohol on him.

There wasn't a whiff of marijuana in the car for them to notice.

They LIED on their police reports.

And those LIES, said the fat lady, SING to all HEAVEN that we have a major problem in law enforcement that can't be glossed over by some wife who will demand the public bow to these brutes in blue, black, or whatever color you want them in.

That THEY LIED should scare the hell out of every Bakersfield resident. He didn't attack them. He didn't have a gun. He wasn't a gang member. There were no gang tattoos. The car itself showed no signs of drug activity.

If you turn a blind eye to this now, then you turn a blind eye to your children's future.

BPD needs to go find some real crime and stop harassing Innocent citizens.

 

And you had the nerve to correct me......What country are you from because it can't be America? Don't ever attempt to correct a typo when you make no sense what-so-ever on your post....

My point is we all make stupid mistakes but I think your mistake is more than a typo.....you either have little to no education or you have difficulty understand the English language....

Tip: Don't ever correct the mistake of any one on this blog again....you are not qualified.

I agree with Gaslight, drug war what,?????if you are presumed to be a criminal until you are proven not....these are the people your tax dollars are paying to " protect and serve", If you have no confidence in the BPD then it`s best you do not venture into the city limits to " dine, shop",or otherwise spend your hard earned paycheck within the city limits, you do have a choice to put the standards of the BPD in order, it is a shame that the BPD is possibily the bottom  entry level for recruits looking to move on to greener pastures, but if they do not learn here then the move on will not become a reality, hence the old timers who did not have what it took to move up...

And what about the Kern County Sheriff's Department???   I have a neighbor down the street who claims to know of a group of Deputy sheriffs who smuggle drugs into Lerdo.  He has never given any names and I figure this is none of my business unless I am directly impacted.  I figure they will get caught eventually, as others have.  What is going on with sheriff's department and why are so many of them corrupt.  Actually I have another source of information concerning drugs going into Lerdo.  someone in my family just got out of Lerdo for a drug charge.  She said if you knew the right people you could get what ever you wanted.  Hmmmmm!!!   So this is what our tax money  is paying for.  I don't like to hear things like this and tend not to believe most of these bad stories, but I have two different reliable sources of information, so I can hardly think they made it up.  Also they do have a history of bad deputies with drugs in the past.  It is sad that these kind of people are hired to protect the citizens and be guards over prisons, when they are just as bad as the prisoners.

Back to the subject...was this the Doctor's first stroke...does he have a history of strokes...if so, why in the hell was he driving..this should be researched further....

What part of the vehicle code says that "if driving after having a stroke in prior years, subject will be handcuffed and refused medical care",,,

I was under the impression that a practicing surgeon had the ability to drive also...

I imagine its hard to have no bad apples in an outfit as big as the Sheriff''s Dept in Kern. Their website says they have over 1,400 employees. There will always be some bad ones in an outfit that big, you know that.

I thought the KCSO had Detentions Deputies in the Jails and not Deputy Sheriff's (seems a big difference to me, maybe not to some) so Sox, I think it would be good to refer to them as such, just for the sake of fairness, don't you?

How should I address your issue timec? Apparently you want to pin point my race. You know absolutely nothing about me. Just like I don't know anything about you. Quite frankly, I could care less about you and anyone else on the net. As for my education, we don't have to go there, since I know where I stand and I'd probably make you look bad. I probably have more education than you could ever dream of. So dish your hate. I'm not going to have a special olympic debate with you because even if you win you are still a di-didi! Ok Chico:  If you say so.  I really don't see what the difference is, but I will refer to them as detention officers. 

I would never have brought this up, but it seemed to fit into our general subject of law enforcement.  Just too bad there are so many dishonest officers out there.  Now my neighbor, whose name is Doug and that is all -- just Doug -- he is very hard working and I am sure he is conscientous about doing a good job.  We have known him for 15 years, so I can safely say he is a good guy.    

giving the correctional and detention officers credit, I think they mostly do a very good job.  I sure would not want to trade jobs with these people who work in prisons and jails.  I am sure they earn every cent they make.

The average  "real peace officer" doesn't go into the job with that  "work"  ethic in mind. Does he?

Come on, people!  How hard is it to distinguish a sick person from a drunk one?  How hard is it to be a human being?

This is a clear case of BAD COPS!  Because of these lousy cops... careless cops.... inhumane cops...  we lost a very much needed  and highly skilled physician... who helped our sick newborns and infants get well... who gave their time and efforts for the sake of giving parents new hopes with their children.

I can imagine the horrific time his family is going through!


 A whole family's life is effectively destroyed due to loosers called cops..... who could not perform due diligence while watching a man collapsing before their eyes!

He had vomit on his shirt.... so what?   Is alcohol the only cause of vomit????

Calling an ambulance and turning it away is a CRIME....  These cops are murderers and must be punished to the extreme extent of the law.

These cops must be jailed...  with pictures of this doctor posted all over their cells' walls... to see what they have done!

Dr. Harb's wife:  I call upon you to demand at least $350 Million dollars.... the city MUST realize the severity of the actions of those cops!

Well, Sherlock Holmes... Dr. Harb is not even "kickin" !  He's not talkin... he doesn't remember a thing....  he will not be able to practice medicine..... He's going through physical therapy to help him do some of these activities.

  Life is not breathing only.  When you are injured at work, your employer will send you home.... and later terminate you!

Thank God they did not shoot him when he tried to put the key in the ignition... Thank God they did not shoot him when he threw up, because that could be assault with a deadly weapon....  and Thank God they did not shoot the nurse who approached them thinking she posed danger...
