More information on Westdale Drive shooting released
Synopsis: Update on Westdale Drive Shooting
Details:
This is a news release of the Kern County Sheriff's Department.
Please do not contact the Sheriff's Communications Center.

Date:     Wednesday, November 07, 2007
Time:     11:17:47 AM
Department contact: Sgt Ed Komin
Phone: 303-4592

Details:
The continuing investigation into the shooting on Westdale Drive has revealed that two adult males had
driven to Stewart's residence just ahead of Espino and Torres.  The two males are identified as 23-year-old
Cesar Montoya and 29-year-old Jesus Delgado Estrada.

Montoya and Estrada are brothers and Espino is their cousin.

Investigation revealed that the four suspects went to Stewart's residence in two separate vehicles.  One was
occupied by Espino and Torres, and the other by Montoya and Estrada.  Once the two vehicles arrived on
Westdale Drive, Montoya and Estrada pointed out Stewart's residence to Espino and Torres.

After Espino and Torres fled Stewart's residence, the two vehicles met in the area prior to summoning
medical aid for Espino.

Sheriff's Homicide Detectives and deputies from the Sheriff's Special Operations Group served a search
warrant at Estrada and Montoya's residence at 1825 3rd Street, Apt C on 11-6-07.  A large sum of money and
two firearms were seized, one of which had been reported stolen in 2006.

Montoya and Estrada were both arrested for the murder of Espino, the attempted murder of Stewart,
attempted arson and conspiracy.

I watched this guy tell Channel 17 that he and his friends went to this residence with the intention of committing murder and arson..but he didn't want to say too much because he still has to go to court....DUHHHHHH.........dummy..you just fessed-up on t.v....you didn't leave any gray areas there---smaarrtttt..........

The homeowner is not telling the whole story. He was justified in killing the creep, but something smells fishy. Why would somebody you don't know not only break in your house, but want to murder you, and set it on fire. I wouldn't be surprised if the homeowner was doing something illegal but doesn't want to fess up. I bet this is over drugs.

soltini. you have evidence of that? If it's true the police will find out about it. They are not dumb. Until that time it's not a good idea to toss out unverified rumors. Someone connected may visit you.

soltini, you better keep your mouth shut, as you don't know what this is all about.  I can tell you are not very street wise.  Rumor has it that these people were going to kill this man and burn down his house because they had information that he was a child molestor.  He is not a child molestor, so much for megans law huh?

Until then soltini, I would keep your thoughts to yourself.....we have put enough innocent men in jail, don't try and do this to a man that was defending himself and his property.

Culver...since you're the only one who mentioned child molestation I'd say you're the one starting rumors.

Sorry Nancy, it was on the 6 o'clock news, not something I just made up.  If you would watch the news for the facts, then you wouldn't have to blog yourself to death everyday.

A lengthy investigation was done on this young man, and found no sex crimes against him, which now has made it harder for law enforcement to try and figure this one out.  No drugs were mentioned, but the sex offender was mentioned.

Nancy why don't you just stay a old old surfer girl, and with me being a retired cop, I know just a little more then you do.  By the way i never saw you in your polka dot bikini.................thank God.

It is unfair to speculate as to why Steve is the victim of this murder for hire crime and I am CERTAIN the investigation will reveal the source eventually and now have some viable leads.  These men were not vigilantes and may not know why he is the target themselves nor did they care.  I know this man personally for many years and know many of the details first hand.  First off he is in NO WAY a criminal or involved in any criminal activity, he is a victim and trust me ANY of us could be one at any time and it seems their is no end in finding willing participants for hire.  He is not making coments at this time, simply because he is still a walking target and does not know the source and this was at least the second attempt on his life.  The first one reported someone shot at his house, the truth is someone shot at him while sitting comfortably on his couch and missing him within an inch of his life.  He has not had a moments peace since that time and is virtually in a survivor mode, until this is resolved and because of recent events he has every reason to fear for his life.  Their are many people speculating as to why he has become a target including those reporting the news and this is very unfair to Steve, his life is turned upside down over this and lets not forget he is the VICTIM!  He is NOT a child molester and is NOT into drugs or gangs or any thing criminal, is is just an average good ol guy a really GOOD ol guy. These men were not there to rob him they were there for a paid kill, to shoot him and to set him on fire, the house burning down would be incidental to the way they planned on killing him and for all those who know and love this man THANK GOD and whatever entity who has been looking out for and protecting him.  We all pray this nite mare will end soon for him and he will remain protected from harm.  I hope readers of news and its source will treat Steve with the respect he deserves and as the VICTIM here and not as someone who may have deserved what he had coming to him, I can tell you FACTUALLY he did not.

ddw, you really touched my heart. Thanks. Since Steve has been a defendent in court so many times, I bet it's kind of nice to be a victim for once.

OldBlue56, Excuse me for defending this VICTIM!  Their is nothing in his past history that would indicate he would or could be involved in any thing as criminal as being is being speculated.  The fact he has a past record of MINOR incidence of which you know nothing of the facts, does not mean he is not a good person or that he deserves to be a target for MURDER!
posted by OldBlue56 on Nov 12, 2007 at 11:24 AM
Okay, so he is a MINOR criminal. Let me rephrase that, a minor criminal who is a good person.
posted by sagefever on Nov 12, 2007 at 11:31 AM
I thought that was the point:corrections? To turn a person's life around. No matter, being the target of murder is certainly beyond the pale.As the case unfolds we will hopefully find out more, now it is still innocent unless proved guilty for all parties involved~ under current U.S. law.

OldBlue56, I said nothing of him being a "Minor Criminal" I said "minor incidence" and as far as I know not even a past "CRIMINAL" record at all nor "QUILTY" record and nothing to sugest he may have ever been involved in any "Criminal" activity or even being acused of such.  If traffic violations and minor incidents which may land a person in front of a judge is considered as what would make one a "Minor Criminal" who may become suspect in becoming a Victim of a "Murder for Hire"  the majority of us my be at risk as well.  FYI he has made some of these court appearances as the Petitioner and not the Defendant.  We may all be very suprised as to what "Upstanding Citizen" may have been behind all this in the end .....

It may be that Steven Troy Stewart aka David Emery Miller is not the same Steven Stewart whose life was threatened last week.   If it is the same person, then he is no "minor criminal" and it is not unreasonable for some of us to be suspicious as to why someone would want him dead.  If it is the same Steven Stewart with the lengthy criminal record, one would wonder why such a close friend wouldn't know of it.

dgrealish, Here we go again and exactly why rumors get started.  You mean David Emery Miller aka Steven Troy Stewart?  That is the man who stole Steve's identity for a period of time, before getting caught and yes people who know Steve might also know that as a fact.  The funny thing is Steve Stewart the REAL Steve Stewart is 6' 7" and the man who stole his identity was not even close to that proximity and let alone look anything like him and yes you are right Mr Miller does have a lengthy criminal record, which includes using the false identity of Steve's.  So please dont go spreading rumors of your own ignorance about this matter.  By the way it's all over now and you'al will be very suprised to hear of the who and why and as all of us who have been going through this whole ordeal with Steve these past several weeks are not at all suprised by and would know for sure it had nothing to do with any "criminal" past or present, as I said Steve is a good man!

Culver....

"Sorry Nancy, it was on the 6 o'clock news, not something I just made up.  If you would watch the news for the facts, then you wouldn't have to blog yourself to death everyday."

No..I'd just sit around "everyday"and listen to news that is often changed by the next broadcast.

"Nancy why don't you just stay a old old surfer girl, and with me being a retired cop, I know just a little more then you do.  By the way i never saw you in your polka dot bikini.................thank God."

Whew..glad you're an EX-cop.  I'd hate to think our safety lies in the hands of someone who doesn't know the difference between surfing the sea in a polka dot bikini and surfing the internet fully clothed.  Besides...ya gotta love someone who throws in the "old, old" to bolster their own self image.  Like that has anything to do with anything.

Did I strike a nerve little fella?  Must have or you would have just explained instead of initiating a personal attack.

I understand why you would be sensitive about this, but I'm not starting rumors.  I simply stated an opinion based on court records and I prefaced my opinion with the word IF.  You might want to prepare yourself.  This could be a long ugly road for your friend.  Save your anger and indignation for those who deserve it.  I know Nancy.  She didn't deserve it!

There are always rumors in cases like these.  When few facts are known, it is natural for the human mind to speculate.  The general public is not privy to all the facts.  The police keep things from the media for a reason…and sometimes they plant things in the media to catch a criminal.  If Steve is smart, he’ll refrain from making any more comments to the press like, “…maybe an ex-girlfriend…”  The statement alone has caused a lot of grief in my circle of friends since we know one of his ex-girlfriends with whom he has had a very unhealthy and volatile relationship with for years.  Could she have gone off the deep end?  It’s hard to believe she would think that a hit for hire was easier to obtain than a restraining order.  Or is it that Steve has seen an opportunity to make her squirm for his own hateful reasons?  If the public is speculating about these things, you can bet the police are questioning the same areas.

If the men arrested were hired to kill Steve, I believe the conspirators will be named.  I doubt there is anyone in Kern County powerful enough to keep them from talking.  We just don’t have that kind of mob power in this pumpkin patch.  They certainly are not professionals.  I don’t know Steve, although I have met him a few times, and I have no idea why anyone would want to kill him (unless of course his ex-girlfriend really has lost her senses), but I do hope the story comes to an end and the truth comes out so he can go on with his life without having to look over his shoulders.

Regarding his criminal record, if you don’t know the person, it is not likely that you can be sure you are looking at his record or the record of someone else with the same name (or using his name illegally).  So for those of you insisting he is a criminal, you cannot know that unless you know him personally.  If the records on the court website are regarding the same Steven Stewart, it would seem as though is violent past has come back to haunt him.

Steven Stewart is a victim until law enforcement determines otherwise, not the public.

Hold onto your hats.  After the chiding I got for my "IF" statement, this should cause one heck of a backlash.  I think I'll just sit back and take names.
