Sometimes we must report on painful subjects
Reader: Jason Jauch, the man accused of drinking and driving and causing the head-on collision on Highway 58 on the morning of June 30 at 7 a.m. was slandered and his character was defamized by the media. Allegedly, he was drunk, struggled with police, and walked away with scrapes, bruises and a broken leg.

Unfortunately, the accident left a 4-year-old boy dead and others injured. The "others" were described as having serious/critical injuries, while Mr. Jauch's injuries were moderate. The truth is that Jason had his last drink at 11 p.m. the night before, which gave him 8 hours to sober up; he suffered a broken femur, broken tibia, punctured lung, ruptured spleen, broken eye socket, and broken nose from the accident, so how was he able to struggle with police and how are these considered anything but serious/critical injuries? The children were not properly restrained in their seats.

Mr. Jauch fell asleep on his way to work that morning and a tragic event unfolded. And to add to the drama, the media had to heap on to the terrible events accusations and lies. When will the media get sued for slander or defamation? I don't know, but I'd love to be on that jury!

First, a little background. The accident to which you refer occurred Friday, June 30 on Highway 58 near Comanche Drive. Octavio Chavez was headed west, Jauch was headed east. According to the California Highway Patrol, Jauch crossed the center divider and hit Chavez head on. We did report that two of the three children in Chavez's vehicle were not properly restrained, including the 4-year-old who died. The CHP said Jauch was intoxicated, that he violently struggled with officers and would face felony DUI charges.

Contacted Friday, a representative of the CHP said that is an accurate reflection of what happened at the scene from the officers' point of view. The office has sent felony DUI charges to the District Attorney's office, which decides whether to prosecute. The assigning deputy district attorney said she received the charges Thursday and they are still pending. When, and if, the D.A. does file charges, we will report that. If they decline to file charges, we will also report that and why.

It was a terrible accident and everyone involved is suffering. We understand that. But we need to report what happens in the community, even when it's sometimes hard or hurtful. We did our job and will continue to do so, despite threats of lawsuits or any other type of retribution.

Even if he did stop drinking at 11 pm (which is what all drunks say when they are involved in an accident or are arrested), depending on his alcohol consumption and, physical activity while intoxicated, and his weight, he could possibly still be under the influence while driving...  But the CHP didn't say he was under the influence, they said he was intoxicated, which is even worse.

The police (especially the CHP) know what they 're talking about when they say someone is intoxicated...  And the tests they run on you to confirm your intoxication don't like...  Unfortunately, drunks often do.

i KNOW this guy really well and i just wanna say for the record.....that this was just an extremely irresponsible choice on jason's part to have gotten on that freeway or on the road at all for that matter when he knew he was as exausted as he was that morning.but i can say this:he has about 5 1/2 more yrs. to wish he had done it all DIFFERENTLY if given a chance! i also know that if jason could,he would trade places with that little boy in a heartbeat.so instead he's got to learn to forgive himself and figure out a way to survive where he is, and begin to move on with his life he has out here waiting for him.i'm just saying.....I LOVE JASON'S LIFE AND HE'S NOT A BAD PERSON AT ALL, HE JUST MADE A REALLY BAD DECISION HE WISHES HE COULD TAKE BACK!! i guess they say:"LIVE, & LEARN BY EXAMPLE!"    much love/respect, SHALAINA :)  miss u jason!MUAH'S

Mr. Glann, assuming the CHP returns a blood test for alcohol that exceeds the legal limit for your friend, will you then apologize for your defamation and slander of a) local media and b) local law enforcement?
