Would you charge a victim of robbery, assault for possession of pot? - Breaking News - BreakingNewsTeam's Blog - Bakersfield.com

Recently we reported that the Bakersfield Police Department was looking for two men suspected of being part of a trio that assaulted and robbed a man and his roommates Monday while at the victim’s apartments. One was arrested.

The man met the three suspects near Cal State Bakersfield, and the group then went to the victim's apartment. Once inside, the three held up him and his roommates using a gun and ransacked the place, police said.

They took money, property and marijuana from the victims, pistol-whipped one and hit another with an ax handle before leaving.

Marijuana?

I asked Sgt. Greg Terry with the police department whether the victim was charged for having marijuana – he said no. I asked him if he would be – he said it was an ongoing investigation.

Should police charge the victim for possessing marijuana? Should the victim have reported that the suspects stole his marijuana?

If he had a 215 [?] medical card he should report the theft. If not he should just eat the loss and shut up. The San Luis SO was forced to return another legal pot users marijuana yesterday. I think it has happened in Kern County before also.

May 7, 2008 at 05:05 PM : Jorge, let me ask you...

Jorge, let me ask you some questions...

Does the "victim" get his marijuana legally, from a legitimate provider?

Does he legally grow it himself?

How much marijuana was stolen? Was it less than an ounce?

How would the DA prove the "victim" possessed marijuana if all the "evidence" was stolen? (His admission alone won't cut it).

Inquiring minds want to know.

Wow... as I sat here reading Oldblue56's comment, I paused, finding myself in the midst of a classic Kubler-Ross grief cycle.

Shock - I couldn't believe he posted a rational comment without insulting someone

Denial - I checked several times to be sure it was really him

Anger - how dare he toy with my emotions like this!

Bargaining - Maybe he was ill or having an off day

Depression - realization that all I had assumed could be wrong

Testing - I decided to laud him publicly and hope for his continued reticence

Acceptance - The realization set in that maybe he had mellowed and I would have to live with a new, improved Oldblue

The credit crisis, housing bubble, rampant inflation, and now this... Is there no end to the horror?
