Great news now my home state has joined MA in recognizing same-sex marriages.

For those who oppose same sex marriage here is some simple advice:

1. Don't attend a same-sex marriage
2. Don't enter into a same-sex marriage
3. No Church, minister will be forced to perform a ceremony for a same-sex marriage

Tomorrow the sun will still raise as sure as the price of gas is going to go up.

We have far more important matters on hand to work through than attempting to overturn the courts ruling. We have higher price for food, gas, utilities, state & national debt, health care, poverty, national security.

AllRed, not to worry, I am not moving back anytime soon. Though I was there in Bakersfield for a week taking care of a sick relative.

Apparently, the rule of law and the idea of Separation of Power no longer means anything in California. The voter approved law very clearly says that gay "marriage" is banned in California. Domestic partnership provisions have been given to homosexual couples. What does this do except try to destroy marriage? Another victory for illogical judges. I think we all learned in high school about the judical power to interpret laws, the congress (or the legislature, people of California in this case) power to make law, and the President (or in this case the Governors) power to enforce law. No matter how you spin this, the FACT is that the state supreme court has just made law and overuled the will of the people of California. This is a sad day for Constitutional Democracy.

This is a perfect example of why judges are so important and the choice of them are.

I'm not sure how I feel about this decision, not because of the result but because I thought California voted the other way multiple times and now that is reversed by a few people, the judges

Those people just made law they did not enforce it. What happens later I wonder?

States should be able to make any and have any laws they want as long as its not unconstitutional. As far as I know Gay marriage or marriage of any kind isn't unconstitutional, California voted to keep marriage defined as between a man and a woman. That should be upheld until voted the other way if at all.

I just don't like this legislate from the bench crap.

Does this make sense to anyone or just me?

The majority of judges ruling on this case were appointed by Republicans.

.

And they made the correct legal decision, too. They are merely pointing out that the voters were in error when they tried to impose an unconstitutional ballot measure. I would think you'd appreciate the correction. How else could you know about mistakes, but to have them pointed out?

And they framed it properly, and it will set precedent for other cases--possibly including Pax's little bigot-ridden anti-777 petition.

As to what happens later, why, a whole lot of happy couples get married and every straight marriage in the state is instantly invalid. (I made up the last.)

The voters approved of a discrimatory, and thusly, illegal ban against people with different sexual orientations (and, obviously, 'religious' beliefs) than the norm, and the California Supreme Court finally woke up and said "yeah, that actually was wrong".

But I guess this merits much more outrage than, say, when the people of California voted in the Medicial Marijuana law and had the feds say "Yeah, right."

Funny, Superman...exactly how is this a Christian nation when numerous members of the founding fathers, including 4 presidents, were anti-organized religion?

And I have read the constitution. Notice the part about 'no state religion'? Have you even read the First Amendment? Here, let me post it for you:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Translation: You can practice whatever religion you want. But you cannot use that religion as the basis for laws, nor can you let religion dictate legal maters. You can't shaft someone for going against Christian teachings.

I'm full of questions.

I don't get it...why are so many "California voters" against gay marriage? Will preventing the marriages make people not be gay anymore? Is that the hope? Will having gay marriages in California make straight people turn gay now? If gay marriages are sanctioned does it affect straight marriages? Is my marriage on the rocks now? Will my husband turn into an abusive jerk as God's wrath curses the straight marriages?

How can we enact legislation to keep the liars, thieves, idol-worshipers and coveters from marrying, and possibly driving, too?

Thanks!

Sixty years ago, in the case of Perez v. Sharp, the California Supreme Court was faced with the following set of facts:

"In this proceeding in mandamus, petitioners seek to compel the
County Clerk of Los Angeles County to issue them a certificate of
registry (Civ. Code, § 69a) and a license to marry. (Civ. Code,
§ 69.) In the application for a license, petitioner Andrea Perez
states that she is a white person and petitioner Sylvester Davis
that he is a Negro. Respondent refuses to issue the certificate and
license, invoking Civil Code, section 69, which provides: "... no
license may be issued authorizing the marriage of a white person
with a Negro, mulatto, Mongolian or member of the Malay race."

Showing the same courage that the Court showed today, The California Supreme Court struck down the statutes prohibiting marriage between persons of different races as unconstitutional. Those opposed to the decision made most of the same arguments the the persons opposed to today's decision have made. In particular, they accused the court of interfering with the will of the people. In retrospect, of course, the decision was completely correct.

Sometime down the road, the storm will blow itself out, and people will ask what all the fuss was about.
Question, Do you...

Sax,

Question, Do you believe that saying 4 presidents were against organized religion (not anti religion) and that the founders who came from an oppressive government doing what they could to prevent a similar situation from happening in the US, means the US is not a Christian nation?

I would argue that our most basic laws, notions and words written in all of our founding documents point, if not yell the fact that we are.

Let me ask you one other question as a man obvious so well versed in history and not at all obtuse to the facts,

Where do you get your rights from?

Bigjpop, don't hold it against RF personally, I think he honestly just doesn't know better. I do think though slowly he will come around. One day he will check some of those positions he holds with facts to see if they hold water. When he realizes they don't I think he will be just as stubborn and unwilling to let anyone effect his opinion for the Right side as he is for the left now.

Until then be prepared to read poorly thought out lib talking points

Saxon, you know...

BS,

Saxon, you know it. Now *THERE* was a religion which knew who was in charge:

When Anu the Sublime, King of the Anunaki, and Bel, the lord of Heaven and earth, who decreed the fate of the land, assigned to Marduk, the over-ruling son of Ea, God of righteousness, dominion over earthly man, and made him great among the Igigi, they called Babylon by his illustrious name, made it great on earth, and founded an everlasting kingdom in it, whose foundations are laid so solidly as those of heaven and earth; then Anu and Bel called by name me, Hammurabi, the exalted prince, who feared God, to bring about the rule of righteousness in the land, to destroy the wicked and the evil-doers; so that the strong should not harm the weak; so that I should rule over the black-headed people like Shamash, and enlighten the land, to further the well-being of mankind.

Hammurabi, the prince, called of Bel am I, making riches and increase, enriching Nippur and Dur-ilu beyond compare, sublime patron of E-kur; who reestablished Eridu and purified the worship of E-apsu; who conquered the four quarters of the world, made great the name of Babylon, rejoiced the heart of Marduk, his lord who daily pays his devotions in Saggil; the royal scion whom Sin made; who enriched Ur; the humble, the reverent, who brings wealth to Gish-shir-gal; the white king, heard of Shamash, the mighty, who again laid the foundations of Sippara; who clothed the gravestones of Malkat with green; who made E-babbar great, which is like the heavens, the warrior who guarded Larsa and renewed E-babbar, with Shamash as his helper; the lord who granted new life to Uruk, who brought plenteous water to its inhabitants, raised the head of E-anna, and perfected the beauty of Anu and Nana; shield of the land, who reunited the scattered inhabitants of Isin; who richly endowed E-gal-mach; the protecting king of the city, brother of the god Zamama; who firmly founded the farms of Kish, crowned E-me-te-ursag with glory, redoubled the great holy treasures of Nana, managed the temple of Harsag-kalama; the grave of the enemy, whose help brought about the victory; who increased the power of Cuthah; made all glorious in E-shidlam, the black steer, who gored the enemy; beloved of the god Nebo, who rejoiced the inhabitants of Borsippa, the Sublime; who is indefatigable for E-zida; the divine king of the city; the White, Wise; who broadened the fields of Dilbat, who heaped up the harvests for Urash; the Mighty, the lord to whom come scepter and crown, with which he clothes himself; the Elect of Ma-ma; who fixed the temple bounds of Kesh, who made rich the holy feasts of Nin-tu; the provident, solicitous, who provided food and drink for Lagash and Girsu, who provided large sacrificial offerings for the temple of Ningirsu; who captured the enemy, the Elect of the oracle who fulfilled the prediction of Hallab, who rejoiced the heart of Anunit; the pure prince, whose prayer is accepted by Adad; who satisfied the heart of Adad, the warrior, in Karkar, who restored the vessels for worship in E-ud-gal-gal; the king who granted life to the city of Adab; the guide of E-mach; the princely king of the city, the irresistible warrior, who granted life to the inhabitants of Mashkanshabri, and brought abundance to the temple of Shidlam; the White, Potent, who penetrated the secret cave of the bandits, saved the inhabitants of Malka from misfortune, and fixed their home fast in wealth; who established pure sacrificial gifts for Ea and Dam-gal-nun-na, who made his kingdom everlastingly great; the princely king of the city, who subjected the districts on the Ud-kib-nun-na Canal to the sway of Dagon, his Creator; who spared the inhabitants of Mera and Tutul; the sublime prince, who makes the face of Ninni shine; who presents holy meals to the divinity of Nin-a-zu, who cared for its inhabitants in their need, provided a portion for them in Babylon in peace; the shepherd of the oppressed and of the slaves; whose deeds find favor before Anunit, who provided for Anunit in the temple of Dumash in the suburb of Agade; who recognizes the right, who rules by law; who gave back to the city of Ashur its protecting god; who let the name of Ishtar of Nineveh remain in E-mish-mish; the Sublime, who humbles himself before the great gods; successor of Sumula-il; the mighty son of Sin-muballit; the royal scion of Eternity; the mighty monarch, the sun of Babylon, whose rays shed light over the land of Sumer and Akkad; the king, obeyed by the four quarters of the world; Beloved of Ninni, am I.

I usually try to avoid mind numbing retorts like yours, Pax, because nothing I say in response will make the slightest difference in your outlook, or your bizarre desire to make other people conform to your obnoxious view of what is righteous and just in this world. If my "mama", as you say, had decided against having baby AP, I just wouldn't be here. I guess, too bad for you, she decided to put up with my nine month lease in her Uterus Hotel and plopped me out into this crazy and bizarre world. Unlike you, Pax, I allow other human beings to make their own medical choices without judgment or criticism. That's life! I always find it so arrogantly hypocritical when I read and hear the supposed small government libertarian types go batty over anything that has to do with the human body and then demand intense governmental legislation/regulation or court intervention to oversee basic human behavior.

Having kids is a social and health issue, not a moral or religious issue. Anyone can have one. It ain't special! It is interesting to note that infant mortality here in America is much higher than in the more secular industrialized nations that have avoided the religious blathering surrounding health issues.

When this world begins to care for all living people in a kind and sharing environment, and children are not abandoned, or abused, or thrown away when they no longer fit the cute baby role then we can talk about the rights of the unborn. But, until then the unborn are about as real as the undead in my book. There is a lot of talk about how precious the fetus is, until they appear from the birth canal and find all too often the most hostile of climates right at home.

Pax, I realize that you have drunk the Bible Kool-Aid and everything, but we need to put this issue into the context of our social arena, not the antiquated righteousness of your religious philosophy. Since I know you are a little slow, I'll take this step by step. The fact is that this country holds equal protection under the law for all citizens (particularly adults). So if two consenting adults wish to get married regardless of their sexual orientation, under the right of equal protection, they can do so. There is nothing under this statute that provides exceptions to this right. As much as you would hate to agree with me, I have nonetheless proven that the court's ruling today is perfectly in line with logic and law. Furthermore, if you want me to address your take on rights to the unborn, I will. The unborn are not citizens. In order to be citizens, they have to either 1) be born here, or 2) apply and fulfill the necessary steps to become a citizen. The mothers who house the unborn, however, are citizens, and thus we extend the right of equal protection under the law, the right to privacy, and all of the other rights that go along with being a citizen to THEM, not to the growing collection of cells inside them that haven't even developed cerebral cortexes. Once again, I have proven the logic of the law in addition to throwing in that bit of science that people of your ilk conveniently leave out when discussing these issues.

And I know that you like to pick and choose what advice the Bible has to offer depending on how convienient it is to follow, but for you to condemn eternal hell to others because they do not share your beliefs is contradictory to what your Bible says. If there is a maxim in that book that you should follow, I would prescribe this one: Let he who is free of sin cast the first stone.

May 15, 2008 at 04:05 PM : Ok, I'm back. ...

Ok, I'm back. I've drove home and just took my dogs for a walk. I kissed my wife and was reminded that life is pretty darn good. I'm in a better mood now and I'm willing to debate RF.

RF. You compared gay rights to Brown V. Board case (separate but equal). Are you arguing that homosexuals are a distinct race from birth? If that's the case then I would have to say that science is against you. Additionally Separate but equal applied to public facilities. I don't see how you adapt it here to fit your argument. You'll need to explain more.

RF. How dare you insult the Rebels. You're probably one of those people who wanted to change our mascot to the Shields because you found the Rebel offensive.

I want to get back to my original point. The State Supreme Court has just created law. It has overturned a voter approved initiative. The dissenting judges , all 3 of them, agreed that the other 4 were overstepping their boundaries. How can this be anything other that judicial activism. I really am quite shocked that so many people are happy about this. If this was voted on by the people I would not be upset. I'm upset that the will of the people has been usurped by activist judges who imposed their personal views in a legal ruling.

nkoby, while I generally agree with you, I must point out that what fetuses aren't, under the law, is "persons." Their citizenship is irrelevant.

.

It's a thorny legal problem which has been solved by a compromise known as "Roe V. Wade." I will seek to protect that compromise as long as I live.
