From 10:45 a.m. until 11:00 a.m. on the above specified bid opening date, proposals will also be accepted in the first floor conference room of said Public Services Building. 2.Mailed via United States Postal Service to Kern County Roads Department, 2700 "M" Street, Suite 400, Bakersfield, California, 93301. after which time they will be publicly opened and read on that date in the first floor conference room of said Public Services Building. No bid will be considered unless it is made on a blank form furnished by the Department and accompanied by bidder's security in an amount equal to 10 percent (10%) of the amount bid in accordance with the provisions set forth under Section 2, "Proposal Requirements and Conditions," of the Standard Specifications of the State of California Department of Transportation, dated May, 2006, as modified by the special provisions. Plans, specifications, and standard Bid Proposal form to be used for bidding on this project may be obtained at the Kern County Roads Department, Plans and Specifications Counter, 4th Floor, Public Services Building, 2700 "M" Street, Bakersfield, California. THIS PROJECT IS SUBJECT TO THE "BUY AMERICA" PROVISIONS OF THE SURFACE TRANSPORTATION ACT OF 1982 AS AMENDED BY THE INTERMODAL SURFACE TRANSPORTATION EFFICIENCY ACT OF 1991. The County reserves the right to reject any and all bids. The contract will be awarded by the Board of Supervisors after a complete contract is prepared to the lowest responsible bidder whose proposal complies with all of the requirements prescribed. The successful bidder must furnish a Performance Bond and a Payment Bond each in the amount of one-hundred percent (100%) of the contract price and on the form approved by the Kern County Counsel. Pursuant to Public Contract Code Section 22300, the substitution of securities for money withheld by Kern County to ensure performance of the contract will be permitted. All documents submitted in compliance with the requirements of this bid package and the contract must be scannable and photocopiable. Each bidder must be licensed as required by law at the time the contract is awarded. Failure of the bidder to obtain proper and adequate licensing for an award of a contract shall constitute a failure to execute the contract and shall result in the forfeiture of the security of the bidder. The contractor license classification required for this project is: A, or C-12. This contract is subject to state contract nondiscrimination and compliance requirements pursuant to Government Code, Section 12990. No discrimination shall be made in the employment of persons for this project. Labor Code Section 1735 and all other applicable State and Federal requirements relating to employment discrimination shall be complied with. Bidders are advised that, as required by Federal law, the State has established a statewide overall Disadvantaged Business Enterprise (DBE) goal. This Agency Federal-aid contract is considered to be part of the statewide overall DBE goal. The Agency is required to report to Caltrans on DBE participation for all Federal-aid contracts each year so that attainment efforts may be evaluated. Pursuant to Part 7 of Division 2 of the California Labor Code (Section 1720 et seq.) the Contractor shall not pay less than the prevailing rate of wages to workers on this project as determined by the Director of California Department of Industrial Relations. The Director's schedule of prevailing rates is on file and open for inspection at the Kern County Roads Department, Plans and Specifications Counter, 4th Floor, Public Services Building, 2700 "M" Street, Bakersfield, California, or may be obtained on the internet at www.dir.ca.gov/dlsr/pwd/southern.html, and is incorporated herein by this reference. If there is a difference between the minimum wage rates predetermined by the United States Secretary of Labor and the prevailing wage rates predetermined by the Director of the California Department of Industrial Relations for similar classifications of labor, the Contractor and all subcontractors shall pay not less than the higher wage rate. The Department will not accept lower State wage rates not specifically included in the Federal minimum wage determinations. This includes "helper" (or other classifications based on hours of experience) or any other classification not appearing in the Federal wage determinations. Where Federal wage determinations do not contain the State wage rate determination otherwise available for use by the Contractor and subcontractors, the Contractor and subcontractors shall pay not less than the Federal minimum wage rate which most closely approximates the duties of the employees in question. The U.S. Department of Transportation (DOT) provides a toll-free "hotline" service to report bid rigging activities. Bid rigging activities can be reported Mondays through Fridays, between 8:00 a.m. and 5:00 p.m., Eastern Time, Telephone No. 1-800-424-9071. Anyone with knowledge of possible bid rigging, bidder collusion, or other fraudulent activities should use the "hotline" to report these activities.
