BAKERSFIELD POLICE USES EXCESSIVE FORCE IN OILDALE ARREST!

On March 11, 2008, Leonard Marella was arrested in the 100 block of Wilson Ave. in the Oildale area.

Upon coming into contact with police Mr. Marella ran.  The reason he ran is because he knew he had a warrant issued for his arrest for a probation violation and Mr. Marella assumed the police were looking for him, however, they were not.  According to the Bakersfield Police Department (BPD), they were looking for another man whom they said fit Mr. Marella's description, however, they later discovered, they had the wrong man.

After the BPD had Mr. Marella on the ground with his hands cuffed behind his back, they proceeded to beat him with their police batons, kick him in the face to the point of knocking out his teeth, taser him in the face with a Taser gun, and allow their police dog to bite Mr. Marella all up and down both legs.  Mr. Marella later had to go to the Emergency Room at Kern Medical Center because the dog bites on his legs had become infected.

We are suppoed to be considered innocent until proven guilty in a court of law.  The police are supposed to be here to Serve and Protect; not beat the living heck out of the suspect.

The entire incident was captured on tape.  A young man named Xavier Zamora saw what was happening and ran to get his video recorder; the police arrested Mr. Zamora for Obstruction of Justice; Mr. Zamora did not interfer in what the police were doing; all he did was take a video of the incident, but apparently, the police did not like being video taped.  Mr. Zamora was within his rights to take video pictures.  The police were very unproffessional and rude to Mr. Zamora.

Right now, there is a case going on in Kern County Courts where 3 Kern County Deputies are being accussed of beating another Kern County inmate to death.

Yes, police brutality does happen in Kern County!!!

Are you familiar with regulations governing law enforcement officers.   Were you there to witness the capture of this suspect? 

Truth is, you don't know squat about the incident but you're ready to blame the police anyway.

 We always have a large panel of experts who neither knew the people involved nor were at the scene when it happened and yet they all KNOW what went on.

The ones who do know someone who was involved always KNOW that the cops were wrong because their friend/relative/neighbo said so.  I'm reminded of those who posted right here on this blog that they KNEW Marshall would have done any of the things he was accused of.  "I've known (insert name) all my life and I KNOW he/she was telling the truth."

Riiiiiight.

His wife's family was never in doubt of his guilt.

 I WAS THERE as Marella was taken into custody, and I DID talk to eye witnesses whom all claim police brutality, so live in your world of make believe, duck under your covers. Marella and Zamora DID NOT deserve what happened to them.

 Audrey, anyone who still believes Brothers was innocent is delusional.  Rational people who aren't pulling the race card know he was guilty.  As for tossing in Bruce Sons, he was guilty as sin too and his son was an idiot for pulling a gun out of a trunk to show cops it wasn't loaded.  I believed in the tooth fairy too until the take wasn't keeping up with inflation.  Anyway..tossing him in the mix is just a red herring to avoid looking racist.

Peek...you say you were there when he was taken into custody and that you talked to eye witnesses.  That sounds like you weren't there for the actual incident.   How close do you live to that neighborhood?  If you live there, you should know the "witnesses" are going to stand behind their own against "the man."  In 1959 I lived at 319 Washinton when my son was born and that whole area was a nice family neighborhood.  Drive down any of those streets just off N. Chester now.  It...has...changed.  And not for the good.

A feller does the best he can then he gets sued fer it!

I saw the parents of one of those subhuman beeyatches on TV who beat the girl (in Fla) and put it on Youtube. He was defendin his little darlin right down the line. Wasn't her fault. The other girl brought it on....on and on.....

I thought to myself.....no wonder these kids are like they are..... look where they came from! Parents who don't parent....then the kids get in trouble and they defend them...... even when they are so wrong and twisted ya could screw em inta the ground!

And too many lawyers just waitin like vultures ta get em ta sue the deep pockets and collect their 33 ta 40% of proceeds.....

Yep, wait er on out....... things may just clear up on their own...... go if ya have ta..... be minimally invasive.... thats the ticket!

 AUDREYB matter of fact i did witness the incident it happened in the 100 block of wilson ave and i live at 133 el tejon it started right in front of where i live I DO KNOW WHAT HAPPENED im not trying to put the cops down for the hell of it. My run ins with the law have never been physical {last one in 2003} so dont try and make it look like i blowing smoke and dont know what i am talking about

 O8er, you can say you witnessed this arrest until you are blue in the face, but it does not take away from the fact these morons both plead guilty to some of the charges and are off to jail and/or prison for a while. And if you live in the 100 block of El Tejon, you will no doubt have many more opportunities to watch the police in action...

What is funny is all these O8er's are saying they witnessed the arrest, but the morons didn't fight the charges. So typical.

And, are you callmetracy's spoke person?

 OldBlue marella pleaded to the charges because he was guilty for having meth on him. why zamora pleaded i have no idea that was kinda stupid he should have fought it because he would have won. But thats still not the point the point is the bpd assalted someone and are trying to get by with it. why do you say i am callmetracys spokes person

 O8er, marella plead to being in possession of meth for sales, plus being a felon in possession of a gun. Not like he was some little tweaker with a dime bindle in his pocket. And zamora obviously plead because he was guilty. Duh!

And the BPD officers did not assault anyone. They used the force necessary to arrest a couple of thugs. While you and Tracy are writing all these blogs, and marella and zamora are starting their sentences, the BPD officers are still out there protecting your lame asses....

 Chico - I think the deputy that came foreward in the Moore case has been completely run out of the department. I talked to a friend of his and it doesn't look like he'll be going back to work. I think it's disgusting and I'm not proud to be a member of the Sheriff's Department in regards to this. From what I understand, the harassment never stopped and now they got what they wanted.

In regards to this latest idiot, you resist, you get what's coming. Once you are restrained, fight's over. Although, I have been bitten, spit on, and kicked by a restrained suspect.

 bakersfield: I don't know, I just read that a Deputy came forward in this matter. I don't believe it was Deputies BTW that were allegedly beating the guy as they have Detention Deputies? down there? Tulare went through this, now they are back to regular Deputies in the jails.

I hope what you say is not true......... that this deputy has been "run off". This would be grounds for a lawsuit in any case if true (by him), but it would also IMO be indicative of a level of corruption and lack of character within the Kern County Sheriff's Dept. I just don't think that can be the case. Not from my admittedly limited contact with Deputies and from what I hear.

I sincerely hope you are wrong in this bakersfield.

 I'm affraid I'm not wrong. My friend is in pretty close contact with him. I went on a couple of calls with him, before and after this and he seems like a stand up guy. Most of us are good guys but it sure would make you think long and hard about coming foreward if something like this ever happened again.

You are right though, it is detention deputies, not Deputy Sheriff's, that are on trial for murder.

BTW, did I mention that most of the spitters and biters were female?

 I wouldn't wanna fight any of the scumbags youse guys have to, male or female. Its one thing to be able to "just let go" when fighting but cops have to be restrained in their response and that would be tough. I would be so tempted to just start throwin on someone who spits on or bites me! (male or female)

I honestly couldn't do it. I wouldn't a been a good cop. I know this.

I still cannot believe that the Deputy who came forward on this is being shunned by others in the Dept, especially the other Deputies. Detention Deputies? Possibly. Real Peace Officers? God, I would hope not!

Whom ever that Deputy is, I wish him the best. He did the right thing IMHO...Some people just have enough pride in what they do they just can't abide others doing it wrong!

I know this --  were I to see people treating cows like those dudes in the PETA video, I'd lose it! Pokin em in the eye with quirts, etc. No way! Cows are food, they are not something to be mistreated along the way!

Same with "customers" of the Sheriff's Dept. Hook em, Book em, Lock em up....... tune em up a little once in awhile if they need it along the way...... but don't beat em ta death. That's not professional.

I still think sangre joven's Dept is good. You guys down there oughta treat your Deputies and Dispatchers with respect. They deserve it!

 OldBlue:  I am wondering if you are a cop!  I have nothing against police because there are good cops and bad cops!  To be honest with you, the police have only helped me out one time and I am forever thankful for that day that particular officer helped me out.  A few years ago, I lived on Marsha St.; One night I was gone all night and, while I was gone, two young gang members broke into my apartment; the officer was driving down the street when he saw the two young men moving stuff.  At that point, the two young men saw the police officer and they took off on the run.  Well, the police dog caught up with one of the young men; the other guy managed to get away.  That police officer that night did a great favor for me and I am forever grateful for what he did.  If I had been home at the time of break in, the two youngmen might of really hurt me because they had a knife in their possession.  I think the good Lord was watching over me that night!  A few times that I have come into contact wih the BPD, the officer was sarcastic and rude without reason.  I have found that the Kern County Deputies are friendlier than the BPD.
