Two beers....yeah right!

Okay, now I have seen the actual newspaper comment in print of the B.A.C. of Mr. Hernandez....and I am not surprised!  According to the D.A.'s office, he was nearly 2 1/2 the legal limit.  So, two beers gets you to 2 1/2 times the legal limit?!  For such a big guy with a drinking history, I am shocked!  California has a legal limit of .08% - SO, if he was 2 1/2 times that....that means he was around .20 - for those who don't realize this....he had consumed enough alcohol to make his Blood Alcohol Content (BAC) meaning, 2/10 of 1% of his blood was ALCOHOL! 

If this does not back up the fact that he should be thrown into jail for life....I don't know what does!!  Let alone the fact that the mother of the child he had with him during his accident - should also be held responsible for child endangerment!  If nothing else, she should have to take some counseling classes, parenting responsibility and alcohol abuse awareness classes!  Okay, maybe this is a little too harsh, but this child was riding with a man who had NO license, NO insurance, HAD been previously convicted TWICE of DUI, LEFT his home with the child (presumeably with the family KNOWING he was intoxicated already) and the family - yes, the mother of this child, did NOTHING to stop this from occurring!!!  Am I the only one who sees anything wrong with this? 

(I have blogged about the guy that ran into me and my family on Mother's Day this year, he was .26%, and about falling asleep while we talked to him - not to mention that he was leaning against everything he could find so that he didn't fall over!)  I don't know the difference in weight, etc.  However, I do know that Mr. Hernandez and the guy who hit us were both behind the wheel DRUNK and that is inexcusable!

I think you have something a touch wrong, if he was 2 1/2 times the legal limit his BAC would be about  .2% that's 2/10 of 1 %, not 20% as you stated. If anyone even hit 1% they would be dead.

Thanks for the chart Murphy!  As the bottom of the chart states, different factors may cause alcohol to affect you differently...the chart really shows just how many drinks he must have had to get to 2 1/2 times the legal limit!  Of course, when you are pulled over DUI, the standard answer is "I only had one or two..."  

If you want to get the facts about just how much alcohol you have to consume to get to .08 - check out www.madd.org  and look at the research page.....they give some sobering statistics and facts about those who are at .08 (or over) when they drive.  Also, the DMV, CHP and any other service organization that is out to inform the public will have some great information for you if you don't think .08 is a major amount of alcohol to be in your system!  Either way you slice it - if you are drunk and behind the wheel, it's stupid! 

The other point that I seem to be the only complaining about is the fact that the family of Mr. Hernandez did NOTHING to stop him from leaving with his 2 year old daughter in the vehicle!  If the father is too intoxicated to protect his child - shouldn't the mother or other responsible adult do something???  Does anyone CARE??!!

Is that a rhetorical question about caring? My guess is that this guy probably was not the most pleasant individual to be around when he'd had too many. Maybe the family could not stop him. This case is not about a family, but about an individual who has made a series of really poor decisions, mostly because he's an alcoholic. Just add another blanket to our packed jails.

Adam,

No I was not asking a rhetorical question!  I am sincerely concerned about the fact that this little 2 year old was ALLOWED to leave with her father who had a history of DUI's, a suspended license, etc.  I guess this is a real issue with me because this child WAS injured in the accident - do we all need the reminder of her stitches (I don't recall the exact number) she endured after the accident - and they were on her face, near the nose if I recall correctly?  As a mother of two children near this age - if my boys were being taken by someone who had been drinking, I would risk, life and limb to protect them!!! 

That's the thing that gets me.  I understand the family dynamics of Alcoholism - my father was an alcoholic - and I grew up being taken to bars, seeing my dad stumble out and start the car....with us in it.  NO child should have to deal with this!  I think it's ridiculous to say that this case is NOT a family case.....it is a family case in more than one respect - MANY families have mourned the loss of their loved one.  I think it's horrible to forget that there is at least one supposedly responsible adult(the mother of all four children with Mr. Hernandez) who did NOTHING to stop her child - who was barely old enough to ride forward facing in a carseat - from getting into a vehicle with a man who was not fit to be on the road!

In some Latino subcultures, the man makes all of the decisions. Believe it or not, most of the women like it that way.

It could be he only had two beers.  Some places sell beer by the pitcher...You could consider two pitchers as two beers. ;o)

I've crossed many a Latina; they always threatened me with their brothers or cousins or Tio Leo or whoever, but couldn't do squat themselves, naturally. 

What happened to John Wayne Bobbit was something he brought on himself; after getting drunk and raping his wife, the dumb a** made the mistake of going to sleep. Later, he got into trouble for beating up his next wife. A few women have "Bobbitized" guys; Latinas aren't the only ones who have done it, but 99.99999999999999% of women who say they would do that are full of [bleep], anyway.
