OK trialheads.

We have a 30-minute break, waiting for Timothy Hubbell to return with the letter from Kevin Sluga he mentioned to reporters yesterday.

Cole's attorney, Glenn Kottcamp, wants a copy. He was not aware of it until reading press accounts.

He asked Hubbell about the contents of the letter...in brief the one-page note from Sluga stated "he was responsible for all the Crisp & Cole activities" and the "loan activities for Jennifer and David," Hubbell testified.

The letter won't be made public until after the court's decision is rendered, said the state's attorney. We'll still ask Cole's lawyer and Hubbell if they'll give us copy.

Keep in mind this is just a license hearing. From the state's point of view, it was only interested in proving Hubbell did not write the letter, state's attorney told me.

During WaMu testimony, an entertaining portion of a letter from Crisp regarding the home purchased from Kyle Carter was read into the record. The home was smaller and cheaper than the home the Crisps were allegedly moving from (remember, it was claimed to be a primary residence.)

The letter contained descriptions of the layout, fountains, waterfalls and how Crisp wanted to leave it to his younger siblings and heirs, etc, how the second floor would be so wonderful for the children to play...not a downgrade at all, the letter explained.

Again, he had in place an open-ended lease agreement with Kyle Carter to stay in the house and was at the same time taking out a loan (also not disclosed to the WaMu subsidiary, Long Beach Mortgage) for the New Quay mansion. Claimed as a primary residence.

Cole's lawyer tried to get the witness, underwriter Julie Korman from the Chicago area, to say such agreements are common between buyers and sellers, that if the seller needs to live in the house a month or two before finishing another house, that is OK.

Korman said she had never seen it done, at least at the underwriting level, where she deals with loans.

"Never in documents have I seen that happen," she said.

State's attorney, on re-direct, asked if WaMu would have made the loan had it known about the open-ended lease agreement with Kyle Carter (or the other loans in play). No, she said.

Crisp's cross exam consisted of asking who the account executive was. Christian Gonzalez (not sure of spelling) from the Stockton office, they found in the paperwork.

What if Christian knew about the lease agreement, Crisp asked.

He would be obligated to inform the underwriters, Korman answered.

There are no more witnesses this afternoon, so after Hubbell returns we'll be ending today's session.

Say, what is Crisp driving to the hearing these days? Still leasing that Mercades SLK? Do we happen to know where he's living these days? Does he have an actual primary residence?

Mattloch-

He's staying at a home in Southern Oaks on Fitzgerald Drive owned by a local broker. When I went looking for comment last week I saw a VW bug (new style, silver as I recall but that might be wrong), small white pickup and small Avalanche-type vehicle parked in the drive.

I haven't seen him pull up to the hearings but I think TV has been getting shots. (Judge only allows photos/audio before hearing starts, so there's not much for cameras to shoot other than arrivals/departures etc.) He has no bodyguards etc accompany him that I have seen.

No properties remain in his name, according to the records I'm able to search. I think one remains in Jennifer's name on Windermere but it's in default.

I'll have to double-check but I believe all of the 13 properties in the complaint have since foreclosed or been short-sold.

[EDIT: Ten have foreclosed; one was short-sold; two were later sold off]

Apparently the lawyers aren't able to bring up what happened to the loans in the hearings. I think Crisp himself asked a lender if the loan foreclosed, but the line of questioning was successfully objected to by one of the lawyers.

Oh, and by the way none of us were able to get the letter of Kevin Sluga. None of the attorneys would give it to us. The judge would have, but all three counsel (I say three including Crisp here) objected.

There'll be no hearing tomorrow by the way, so this is it until Monday!

 I'll be off Monday but my colleague Jenny Shearer will handle hearing duties that day.

 

Should be interesting: Several commissioner staffers testifying about the investigation and a former employee, Jayson Costa, who has been a colorful interviewee, are scheduled to take the stand.

Just out of curiosity did Carl Cole belong to a local church group?? Men like him are very dangerous,,the perfect gentleman with an agenda towards children. PLEASE don't fire back at me with maybe he isn't a danger, the guys a freak..

Jayson Costa may just become most important in the truly important trials to follow these hearings.

What is that phrase? Follow the MONEY?"

Men??? A student at the School he was Principal at, a church affiliated school..He was involved with school for eighteen years...He was found guilty of power of authority and molestation, then given 5 yrs probation...Which he promptly moved to Ca. w/ his wife and two children....What!!!

CRAZY - In 2005, "the innocent" Kevin Sluga applied for a construction loan with me and was declined for falsifying his tax returns, (remember, he's the CPA)!!!!!  Did I turn him in...NO...silly me!!!!!  And yes, I paid for his appraisal and inspections on his beautiful Rod Brown built home and was never reimbursed.  Oh, and the interesting part is...Tower Lending ultimately closed his loan!!!!!!!!!  Amazing, isn't it?  The acorn NEVER falls far from the tree!!!!!!!

Guilty, Guilty, Guilty!!!!!  Sorry Tim, you hooked up with a dishonest and  greedy partner...
