WHO GOES TO JAIL?

The rumor is that if there is a domestic dispute between a couple who ever calls police first wins...so if the person who doesn't call the cops goes to jail wouldn't you think people will call 911 more often in an arguement? what if no one uses force, does someone still go to jail? what other questions do people wonder about domestic violence, i need some questions to ask Judge Hoover saturday on our show...

Couple across the street are always at each other. One night the cops showed up. The man was told to find somewhere to spend the night. The threat of violence was enough to keep him out of the house, even though no one went to jail. They are together again and still have loud arguments. I and neighbors hope they'll kill each other. This couple's stupidity stopped being entertainment a long time ago.

catpaw, I'm sure the cops "suggested" he leave the house for the night to avoid any further problems. They can't force him to leave, without arresting him and getting an Emergency Protective Order.

Believe it or not, most of the time neither one of the "fighting" parties calls the cops; the neighbors do. After that, it depends on what the cops find out when they get there. How many episodes of COPS have you seen where some "rule with an iron fist" joker went to jail because his old lady had a swollen eye when the cops showed up? Plenty. The woman never wants him to go to jail, of course, and will often claim that it's "her fault" - she's been conned  into thinking this way by years of intimidation  - and will then get mad at whoever called the cops for "not minding their own business."

KCSD put my daughter and her 3 children out of the house because they said her husband "needed his sleep so he could go to work".  This was about 12 years ago and that marriage ended long ago.  I never understood the reasoning behind putting three children, three and under out of the house, but that was the decision the deputies made.

I PERSONALLY DON'T UNDERSTAND THE SYSTEM THESE WOMAN GO GET THE RESTRAINING ORDERS AND TWO MONTHS LATER THERE BACK TOGETHER AND THE FIRST FIGHT THEY ARE CALLING THE COPS FOR HELP.... DO THEY NOT UNDERSTAND WHAT A RESTRAINING ORDER IS!!!

 

I DO LEGAL WORK AND SEE IT ALL THE TIME I TRY REALLY HARD TO EXPLAIN TO MY CLIENTS THIS IS A SERIOUS MATTER AND NOT TO TAKE IT LIGHTLY.. SO FAR I HAVE HAD TWO THAT DECIDED NOT TO FILE FOR A RESTRAINING ORDER AND THE OTHERS I SEE THEM BACK WITH THE OTHER PARTY..

My comment is people, men or women, know the system. Sometimes men will call the police because they know they will get their spouse locked up...likewise women do the same. People who act in this manner are childish and need to mature. What's worse is if there are children involved then they also get affected. Any person who calls the cops on their spouse, and have children, and don't give a second thought as to the well being of their children is a turd and extremely selfish. People need to think about the children first then their selfish ways. But then again, an educated and mannered person, would know how to act like an adult instead of attempting to play the system. Only losers pull this stunt.

We have a daughter..we raised her since she was 6 and shes now 23..4.0 in high school wanting to be in the veterinary field..shes going to college has 2 cars getting ready to get married to her child hood sweet heart in September..They are living together and maintaining their own bills etc.. She is Spanish and he is caucasian..she has no accent shes acts and speaks very intelligent.. Really dislikes the gang banger mentality ..she wants to  be a professional woman..That is a short short on her character..

  Anyway day b4 yesterday she was out skiing at a lake Buena Vista and she drank some margaritas with her girlfriends and fiancee..it was her day off..she drove her car because he wanted to stay out there longer than she could....on her way home she lost control of her car..their cars are show cars very expensive custom types...hopin she wasnt speeding but she slid into a van..I dont know right now..   The arresting officers for her DUI was a male and a female. The female put cuffs on her and they put her in the back seat..her hand came out because they werent tight enough and she told the female officer what happened..the male over heard her and drug her from the car accusing her of resisting arrest etc..she said she kept telling him she wasnt resisting but he beat the crap out of her...I mean black eye..scratches and bruises all over her body,,she has a bruise on her forehead that makes her look like she has a unibrow..she only weighs around 115 lbs.           What if she had internal injuries or whiplash or what ever from the accident?? He had no right to do that especially under the circumstances..   She went to jail and got out yesterday morning..she called yesterday afternoon and told us about it and she was still crying..last night she called and was still in alot of pain so my wife told her to meet her at the emergency room..She was crying and shaking when my wife got down there. No one has ever put their hands on her like that before.   My question is..does a male officer have the right to put his hands on her like that or should he have let the female handle it..our daughter is very pretty ..I'm thinkin he was getting his rocks off by beating on her..she was still in her bikini top and was having difficulty keepin her self covered while he was attacking her on a public road side with onlookers all around..so now what can we do..he didnt have a right to beat her up like that especially with her in cuffs..can we mess his day up for doing this???

Sioux......File a complaint against the scum bag .....This is wrong in so many ways. He has no right to put his hands on her. Buena Vista is a terrible place to drink and drive. The cops wait for you to pull off. I have been asked to step out of my car before when leaving BV....I stepped out. The cops asked me had I been drinking... I said nope and he let me go. They are jerks out there.

I don't like the way you put she is Spanish but she doesn't talk with an accent. Do you feel just because she is Spanish you have to paint a picture of her that she is an intelligent girl.  Do you think they target Spanish people that talk with an accent and are uneducated? It does not matter if she talks with an accent and dropped out in the 3rd grade...they violated her rights. They need to be held accountable.

Sorry if you took it wrong..I was trying to explain that she is educated and doesnt have a street gang mentality. I was afraid some people reading this would think she has been in trouble before and probablyy deserved it..I think the fact that she is spanish did enter into the officer man handling her though from all the gang violence etc these days..thats the only reason I mentioned it..she is our daughter and we lover her dearly and it really pisses us off that she was handled like this. Im mad right now so please dont start attacking my character for my misuse of prejudicial issues..Believe me Im not there..We are just very worried about how all this is going to effect her future..shes so upset she is refusing to even drive a car again Shes not a drunk ..it was a bad mistake. She said the man she hit ran up while she was still in a daze and tried grabbing her keys from the car and was fighting with and hitting her,,she was defending herself...he bent the keys when he ripped them out of the ignition and told the officer she had assaulted him..That might have started the mind set for the arrest going so badly..all these jerks picken on this tiny petite girl that was in shock from the accident..its unreal..

I really do feel for your daughter and I am not attacking your character. I was just wondering why you used the verbiage you used.....and you explained it. You should not allow that jerk to get away with this. Kern County are professionals at retaliation so you might want to complain after her court nonsense is over. If you complain now they will railroad her in court.....just a tip.

I'm only kidding Sioux...best of luck to your daughter. 0.08 is only 2 beers and not much of a buzz........Hopefully she will learn a lesson from this and not drive when drinking.  As far as the cop being abusive well unless she has witnesses it's her word against his and hes a cop and your kids a drunk.......who do you think they are going to believe........

oh ya there were a few witnesses..she was very embarrased due to him throwing her around and her bikini top kept re arranging itself for all to see. I dont know what her BA was but it still doesnt give him the right to man handle her. The emergency room has her on valium right now because she was so traumatized from the beating..I talked to a friend who was a female officer for many years and she said

A Male officer is not supposed to touch a female prisoner, UNLESS he is personally at risk or someone is at immediate danger.  He had NO right to touch her and do this when there was a female officer there...The female officer should have switched the cuffs to the wire ties that can go tighter since small hand/wristed girls can slip cuffs quite easily.  I would definitely press charges against him.  If a female is arrested on suspicion of say stealing and caught outside the store, Male officers are supposed to "hold" them...and this can be arms against the wall, down, sitting in a chair with hands showing at all times etc...and they have to call for a female to pat them down.  Men are never allowed to pat down in the jail or even go on trips to a doctor etc with out another female present.    We had a minor going to a youth facility and they had a male officer drive, but I went along and got paid just to escort.  There were a couple of women from the office as like secretary staff and such that also would go on ride alongs as escorts for female prisoners....Seriously I would have this investigated...he had no business touching her or even saying she was resisting if she simply brought it to his attention...

From what you have described, the arrest of your daughter had nothing to do with transporting a prisoner to a hospital, ect. No doubt you are upset, but you were not there and are only going by what your daughter is telling you. Maybe she was resisting some when the officer tried to re-cuff her. Some drunks do that you know. Some people get happy when they drink, others get mean. And maybe she slammed her head into the patrol car window and caused the bruise.

I also am curious if you are upset at your daughter for putting her life in danger, and those of others, for driving under the influence of alcohol.

Maybe the officers saved her life by getting her off the road.

Puleeze the officer didnt get her off the road she ran into a van..OH gee whiz no... Im not upset that she was drinking and driving ..what kinda of a stupid statement was that..how many times have you drank away from home and driven yourself..if you say never your lying...you just never got caught..

The transporting to the hos[ital statment was to show those that UNDERSTOOD what my friend the female officer was saying was that they have to take precations even doing something as simple as that DUH!!!

Ive been reading your posts for sometime now and you never have anything nice to say to anyone..whats up ur skirt?? Oh an ya buddy Id love to thank the officer for beating the crap out of her..what kind of lame crap was that?? really loved that remark!!!..did u miss the part where if theres a female officer at the scene he has no right to touch her its up to the female officer and he should have called for one to cuff her???? He over stepped his bounds being a tuff guy ur an idiot im done here got bother some one else. Now I suppose you are going to stalk me around the blogs yakin and puking on everything I say like you do others trying to relive your days of controling your students.....I told you I was hot over this..why do you want to push my buttons??

He hasnt seen her he doesnt know her..shes a wreck..we are very worried about her..shes never been in a fight in her life..this was the first time and having it done by some one you have been taught to respect all your life was very traumatic to a young woman like her..She cant go to work and she wont go to school with her face all bruised up and swollen like it is..Like I said shes very pretty..shes even modeled for some car magazines next to trucks. So maybe you can imagine what shes going through right now. She wasnt just beaten up she feels violated..we saw her today and she was running around in circles at her place..wanted to come over here so we went to get her..then she decided she didnt want to go outside in public still acting very stressed out..I hope she calms down..

her younger brother is coming home tomorrow from a year long tour in Baghad ..we raised him as our son  too..it wasnt the home coming we had planned.

Hope she gets over it.  She made a mistake and I'm sure she has learned from it. It could be worse and another person could be dead so she should really take it to heart.  Don't know if the cop was right or wrong and if the story is balanced or not but she is home and alive and so is the person she hit!  She doesn't have to live with the worst that could have happened.    Some lessons have to be done the hard way.  Who knows how many times she's done this before and never got caught.  Maybe this will end it and she won't have to suffer through something worse.   Anyhow she should be thankful she is alive for the homecoming.

sioux, or is it Sue, I know of no policy by any LE agency that says male officers are not allowed to touch or handcuff a female. They can even pat them down for weapons if it has to be done right then, but it is preferred a female do it.

It is strange that a 115 lb. young woman, who is not a "fighter", would get beat up by an officer for no reason. It would be interesting to read the police report.

And gube, I never had my lunch money stolen. Most of the guys who took other people's money lunch money grew up and ended up in prison for crimes like robbery. Sound familiar?

OldBlue or is it OldBlow...I talked to another friend of mine in the Da's office today and unfortunately the sad fact is she removed her hands from the cuffs and the officer can say what ever he wants to and succesfully get away with his crime..so next time you get arrested make sure since you have the feminine type wrists you keep them where they were placed or you too might meet with a similar fate. Sound Familiar?? Schools out Bucko...
