BAKERSFIELD POLICE USES EXCESSIVE FORCE IN OILDALE ARREST! - LEGALIZE DRUGS? - CALLMEMSTRACY's Blog - Bakersfield.com

On March 11, 2008, Leonard Marella was arrested in the 100 block of Wilson Ave. in the Oildale area.
Upon coming into contact with police Mr. Marella ran. The reason he ran is because he knew he had a warrant issued for his arrest for a probation violation and Mr. Marella assumed the police were looking for him, however, they were not. According to the Bakersfield Police Department (BPD), they were looking for another man whom they said fit Mr. Marella's description, however, they later discovered, they had the wrong man.
After the BPD had Mr. Marella on the ground with his hands cuffed behind his back, they proceeded to beat him with their police batons, kick him in the face to the point of knocking out his teeth, taser him in the face with a Taser gun, and allow their police dog to bite Mr. Marella all up and down both legs. Mr. Marella later had to go to the Emergency Room at Kern Medical Center because the dog bites on his legs had become infected.
We are suppoed to be considered innocent until proven guilty in a court of law. The police are supposed to be here to Serve and Protect; not beat the living heck out of the suspect.
The entire incident was captured on tape. A young man named Xavier Zamora saw what was happening and ran to get his video recorder; the police arrested Mr. Zamora for Obstruction of Justice; Mr. Zamora did not interfer in what the police were doing; all he did was take a video of the incident, but apparently, the police did not like being video taped. Mr. Zamora was within his rights to take video pictures. The police were very unproffessional and rude to Mr. Zamora.
Right now, there is a case going on in Kern County Courts where 3 Kern County Deputies are being accussed of beating another Kern County inmate to death.
Yes, police brutality does happen in Kern County!!!

Tracy, Tracy, Tracy, you are smoking dope again. Didn't you learn not to do that in your drug education classes after your arrest?

First off, do you know the criminal history of Marella? He is a loser! He has MANY arrests and convictions, most for drugs, but one for murder, which I will concede was dismissed by the DA. And you make it sound like he was minding his own business when he ran from the police this last time. Would you please then, explain why he plead guilty to being in possession of drugs for the purposes of sales, AND for being a felon in possession of a GUN? The police should not have used force and a dog on him to comply, they should have put a bullet through his head. Think of how much that would have saved the taxpayers over the next 30 years.

And poor Xavier Zamora. He was arrested and charged with grand theft, possession of stolen property, and interfering with the police that day. He has already plead guilty to the theft and stolen property charges.

So, please don't expect any sympathy from the law abiding citizens out here. Maybe you can get that from all the other drug users you hang around with.

Now, go roll you another joint.

I gotta go with Tom, do what you gotta do till you have him in control, and P.S., running from the cops usually will result in knots on your head.

Bartley, I was thinking the same thing when I scrolled down to your entry. LOL

I think not as I was and I have talked to witnesses who have recalled the same accounts of that day, BPD used excessive force!

Bunch of boot lickers.... Taser didn't work? Please... Was it 4 or 5 cops each had a limb, then say they had trouble restraining him? And you don't know the gestapo they use on you. You get in there and it's bargain time. Go along, go to jail. Don't? Well, ask OB to tell you his favorite joke about suicide. He loves it! Gets off on it. That's the kind of people we're talking about. How about the pig said get back, and Zamora DID just that? How about when the pork said I'll be taking that talking about the camera? Then arrested dude, with no suspicion, charged him, for exercising his 1st Amendment right? Nope, none of that's important. Tweaker, sommmmbit*h got wut he had a comin!

Again, you people have a hard time reading, but please check out "Mean Justice" and your lilly white sheltered lives might gain some insight into the corruption. But then, you people are trained, probably think it's good.

Try this one, what are all these new cops going to do? There aren't that many criminals. Who do you think they're going to start enforcing their will against? I saw 4 on bikes within 2 blocks of eachother on chester. Generating revenue. Brave and all that? Put their lives on the line? Their risk of death on the job is comparable to gardeners, and the No. 1 cause of death of cops is traffic accidents! Just because they don't hang out at bingo halls and pharmacies doesn't mean everyone else has to see 15 of them a day.

John

Speaking as a lilly livered white pig, let me be the first to say you're blowing smoke. I read Mean Streets before it was published in the Bakersfield Californian. Did you know the Shafter Press published it at least 10 years before TBC? The Shafter Press version was less subtle than TBC rendition, if that's possible.

In my opinion, some of it was probably true. But anything written with a TOTAL SLANT like Mean Streets was has got to be taken with a grain of salt. You appear uncapable of making that distinction so I'm sure Mean Streets is like a bible to you and your kind.

Your post reeks of an unpleasant encounter with law enforcement, so I don't think you're capable of being unbiased. Therefore I'll treat your post with the importance it deserves.

My experience with law enforcement having been arrested a few times is usually they don't beat you up unless you ask them to. I have never been hit by a cop. I've been tossed to the ground and jerked around but never hit. Why, because I didn't act like an idiot and resist arrest. Only dummies resist arrest. Resisting arrest is like saying Mr cop will you pleases whoop my azz. You see I never asked them to whoop my because deep down I knew they wouldn't have a problem doing so. When I hear of some tweeker or crackhead who got their azzes whooped my first reaction is they deserved it. In the case of the Oildale tweeker who ran well, he ran so he basically begged the police to beat his azz. With every step he was saying hit me beat me hit me beat me hit me beat me hit me beat me.............................

Even if if was, Audrey is right, it's past history. Everyone knows there is corruption in most law enforcement agencies but that doesn't make them all bad. You're going to find one bad apple in just about every barrel. You complain about too many cops on the streets? You are absolutely the ONLY person I'veever heard say that and I would disagree with you completely. My guess is you're one of those who use the cop/doughnut shop joke while complaining about too many on the street.

This always brings howls from the do gooders but personally I'm glad our cops have a rep for being tough and have a no BS attitude. I like it that people in other areas spread the word that if you want to commit suicide come to Kern County and rob a bank. I don't want a Mayberry group of law enforcement officers.

As has been said ad nauseam, if you don't do the crime, you won't do the time and have nothing to worry about. Cop says stop, you stop. Cop says drop, you drop. It's really pretty simple.

There may or may not have been actionable wrongs committed, that is not for me or you to decide, but the self-policing actions of this one courageous Deputy don't afford you a huge ray of hope relevant to your inveighing against the entire LE community?

As a 35 year photographer, I can say the First Amendment allows you to photograph anything in a public area. That is a right you have under the First Amendment of the Bill of Rights. However, you do not have the right to interfere with the actions of a law enforcement officer. Whether you are six feet away or sixty feet away, if you are causing the officers to be distracted from the arrest, you are interfering with their duties.

Had the photographer actually followed the officers directions and not argued with him, nothing would have come of it. Here in Bako, I have photographed and video taped the officers in the performance of their duties many times and have been asked to step back several times. The difference between my situation and Mr. Zamora is I didn't argue about my rights. I found another position to film the event and didn't interfere with the officer. After the fact, the officer was actually nice enough to apologize for having to ask me to move away from the action.

In short, if you act like an ass, expect to be treated like one.

Its a fine line Nan, but I always hafta think, in today's world, if I was a cop I'd think twice about really doin my job with zeal!

A feller does the best he can then he gets sued fer it!

I saw the parents of one of those subhuman beeyatches on TV who beat the girl (in Fla) and put it on Youtube. He was defendin his little darlin right down the line. Wasn't her fault. The other girl brought it on....on and on.....

I thought to myself.....no wonder these kids are like they are..... look where they came from! Parents who don't parent....then the kids get in trouble and they defend them...... even when they are so wrong and twisted ya could screw em inta the ground!

And too many lawyers just waitin like vultures ta get em ta sue the deep pockets and collect their 33 ta 40% of proceeds.....

                <itunes:summary>

O8er, you can say you witnessed this arrest until you are blue in the face, but it does not take away from the fact these morons both plead guilty to some of the charges and are off to jail and/or prison for a while. And if you live in the 100 block of El Tejon, you will no doubt have many more opportunities to watch the police in action...

What is funny is all these O8er's are saying they witnessed the arrest, but the morons didn't fight the charges. So typical.

And, are you callmetracy's spoke person?

And the BPD officers did not assault anyone. They used the force necessary to arrest a couple of thugs. While you and Tracy are writing all these blogs, and marella and zamora are starting their sentences, the BPD officers are still out there protecting your lame asses....

Chico - I think the deputy that came foreward in the Moore case has been completely run out of the department. I talked to a friend of his and it doesn't look like he'll be going back to work. I think it's disgusting and I'm not proud to be a member of the Sheriff's Department in regards to this. From what I understand, the harassment never stopped and now they got what they wanted.

In regards to this latest idiot, you resist, you get what's coming. Once you are restrained, fight's over. Although, I have been bitten, spit on, and kicked by a restrained suspect.

bakersfield: I don't know, I just read that a Deputy came forward in this matter. I don't believe it was Deputies BTW that were allegedly beating the guy as they have Detention Deputies? down there? Tulare went through this, now they are back to regular Deputies in the jails.

I hope what you say is not true......... that this deputy has been "run off". This would be grounds for a lawsuit in any case if true (by him), but it would also IMO be indicative of a level of corruption and lack of character within the Kern County Sheriff's Dept. I just don't think that can be the case. Not from my admittedly limited contact with Deputies and from what I hear.

I sincerely hope you are wrong in this bakersfield.

I went on a couple of calls with him, before and after this and he seems like a stand up guy. Most of us are good guys but it sure would make you think long and hard about coming foreward if something like this ever happened again.

You are right though, it is detention deputies, not Deputy Sheriff's, that are on trial for murder.

BTW, did I mention that most of the spitters and biters were female?

I wouldn't wanna fight any of the scumbags youse guys have to, male or female. Its one thing to be able to "just let go" when fighting but cops have to be restrained in their response and that would be tough. I would be so tempted to just start throwin on someone who spits on or bites me! (male or female)

I honestly couldn't do it. I wouldn't a been a good cop. I know this.

I still cannot believe that the Deputy who came forward on this is being shunned by others in the Dept, especially the other Deputies. Detention Deputies? Possibly. Real Peace Officers? God, I would hope not!

Whom ever that Deputy is, I wish him the best. He did the right thing IMHO...Some people just have enough pride in what they do they just can't abide others doing it wrong!

I know this -- were I to see people treating cows like those dudes in the PETA video, I'd lose it! Pokin em in the eye with quirts, etc. No way! Cows are food, they are not something to be mistreated along the way!
