Eligibility lawyer: President should be deported

Looks like the buzz over whether Barry Soetoro aka Barack Obama can constitutionally serve as president is getting louder now that "Savage Nation" saw fit to interview Philip Berg, a former deputy attorney general from Pennsylvania (a Democrat, no less), despite Michael Savage's reluctance to give this issue anymore air time now that the elections are over.

A few gems from the chat:

"If it's true what I am alleging, that he's an illegal alien … [Obama] should be arrested and deported,"

"It's a copy of a certification of live birth, which Obama's people put on their website in June of 2008," he said. "It's been documented by our experts to have been altered. It's a fraud. It's a phony document."

"There are million of supporters we have," he said, citing his own "ObamaCrimes.com website. "We are going to continue until we expose Obama. He's a total fraud. He's a phony, This is the biggest fraud … ever in the United States."

So, Barry, I hear you got your family a new pooch today. Hopefully it wasn't a St. Bernard. It won't fare well at all in the steam box that is Indonesia if you are given a court order to go back to where you came from.

Soldier questions president's eligibility

Holy Abu Ghraib ... we have yet another development in the ongoing saga over the questions over whether Barry Soetoro aka Barack Obama can constitutionally serve as president. Now we have an officer willing to risk court martial and shunning advice to seek legal counsel before doing what he's doing. Is our commander in chief ready to say uncle and finally turn over his original "vault" birth certificate to prove he meets the "natural born American" requirement? Heck, it'd only set him back $12.50 to do so. So why has he instead been spending up to a milliion bucks for three law firms to make this all go away? A big salute to this patriotic soldier for doing what the president may not be doing -- defending the Constitution.

Soetoro/Obama a despot?

Alan Keyes thinks so, saying Barry Soetoro aka Barack Obama has something to hide after his lawyers threatened to sue an organization after blocking its efforts to obtain his records from Occidental College to determine his constitutional eligibility to be president. Is this the kind of transparency we can come to expect from his regime?

"The denial of justice is thus a despotic act that violates the basis not only of just government, but of civil society itself," Keyes wrote.

Obama voluntarily placed himself in the position of being asked to provide his information, he said.

"Given the Constitutional requirement, the only fact citizens need to justify their suit is the fact that Obama ran for president. He asked to be chosen, and therefore must answer the eligibility question."

Mr. Soetoro/Obama, WHY won't you put all this to rest by proving you meet the consitutional standards? Is it because you are confident that the people who voted you in office will continue to go along with your ruse? Is it because you can't prove it and you in fact have usurped the presidency?

I have to furnish a birth certicate for my kids to play little league ball but you're off the hook in doing the same for the top office in America despite your oath to uphold the Constitution? What a guy!

I sure remember the Senate voting unanimously in a resolution saying that it had no issue with McCain's eligibility to run for president, not that it officially resolved the constitutional matter as it didn't stop one lawyer from challenging his eligibility as well as Barry Soetoro aka Barack Obama's and a third minor candidate's.

Too bad it couldn't have done the same for Soetoro/Obama to at least partially dissipate that ominous cloud hanging over his head. While that's the fault of Soetoro/Obama, it's still nice to see a lawsuit to put Congress on the hook for not doing its duty to protect the Constitution by ensuring that Soetoro/Obama isn't actually an illegal immigrant (don't forget that one of his picks for a Cabinet post, Mexico Gov. Bill Richardson, once made a slip during a TV interview by calling Soetoro/Obama an "immigrant.")

A lawsuit that accuses Congress of failing to investigate President Obama's birthplace before approving the Electoral College vote giving him the presidency has been amended to include additional claims of rights violations, including unequal treatment, because Congress did such an investigation into GOP candidate Sen. John McCain.

That word comes from Mario Apuzzo, the lawyer handling the case on which WND previously has reported.

The case raises many of the same arguments as dozens of other cases that have flooded into courtrooms around the nation since the November election.

The case was brought by Apuzzo on behalf of Charles F. Kerchner Jr., Lowell T. Patterson, Darrell James Lenormand and Donald H. Nelson Jr. It names as defendants Barack Hussein Obama II, the U.S., Congress, the Senate, House of Representatives and former Vice President Dick Cheney along with House Speaker Nancy Pelosi.

Apuzzo told WND that Congress last year raised the issue of whether McCain was a "natural born" citizen, a requirement set out in the U.S. Constitution for the president, because of his birth to U.S. citizens in the Panama Canal Zone.

According to a report in the Washington Post, the Senate unanimously declared McCain to be a "natural born" citizen, meeting the demand of Article 2 of the Constitution, which states, "no person except a natural born citizen … shall be eligible to the office of president."

The report, however, pointed out that such a statement was opinion only, and the constitutional question actually isn't so simple. It quoted Catholic University associate law professor Sarah Duggin saying the document is ambiguous.

"Ultimately there has never been any real resolution of this issue. Congress cannot legislatively change the meaning of the Constitution," she told the newspaper, saying a constitutional amendment or a U.S. Supreme Court ruling would be the way to reach a determination.

However, even though his clients wrote to Congress requesting a similar review of Obama's birthplace, they were refused.

"The question is: Why do you do it for McCain, but not Obama," Apuzzo told WND (I wish I knew myself).

More specifically, those who doubted McCain's eligibility had an opportunity for a review but not those who doubt Obama (and HE wants to implement the Fairness Doctrine? Chee ... ).

That violates a liberty right for his clients, he said, because as members of a republic, they have a right to know that their president is legitimate (you betcha).

"What I'm arguing is that Congress and President Obama have violated my clients' due process under Article 5 [of the U.S. Constitution]," Apuzzo said.

Already; Congress held a responsibility to make certain Obama is qualified for the post, he alleges. And the public outcry, evidenced by the dozens of lawsuits over the issue, should have prompted due diligence on the part of members of Congress (tsk, tsk), he said.

Obama, meanwhile, has refused to hand over "sufficient documents" to verify his "natural born" status (why?), Apuzzo said.

"We're not a monarchy," Apuzzo said, "People have a right to know."

He said his case in U.S. District Court in New Jersey is at the point where the court notices about the case are being distributed.

He said the fact Obama already has been inaugurated changes nothing in his case (I should say so).

"Before that, everything really was premature," he said. "He has a right to run for office. But when you down to the nitty gritty, he still has to qualify for the position. (of course)"

He said the Constitution specifically raises the scenario of a president who has been chosen for office but has failed to qualify.

"Even though you ran, everybody loves you, you still have got to qualify under the Constitution," (ditto on behalf of those who hate a fraud) Apuzzo said.

Further, the lawsuit explains, not only are there legitimate questions about Obama's birth, and therefore eligibility, he might not even be a U.S. citizen at all.

"There exists a possibility that Obama could be an illegal alien," (oooooh, how does London, Jakarta or Mombasa suit Mrs. Obama?) the lawsuit said. "Obama has yet to adequately prove that he was born in the United States. [Further], Obama has publicly conceded that his father was born in Kenya and a British subject/citizen at the time of Obama's birth which precluded Obama from gaining any U.S. citizenship from his father."

The lawsuits over Obama's eligibility, in various ways, have alleged Obama does not meet the "natural born citizen" clause of the U.S. Constitution, Article 2, Section 1, which reads, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President."

Some of the legal challenges have alleged Obama was not born in Hawaii, as he insists, but in Kenya. Obama's American mother, the suits contend, was too young at the time of his birth to confer American citizenship to her son under the law at the time (thank God at least she didn't confer abortion on him).

Other challenges have focused on Obama's citizenship through his father, a Kenyan subject to the jurisdiction of the United Kingdom at the time of his birth, thus making him a dual citizen. The cases contend the framers of the Constitution excluded dual citizens from qualifying as natural born.

Several details of Obama's past have added twists to the question of his eligibility and citizenship, including his family's move to Indonesia when he was a child and on what nation's passport he traveled to Pakistan in the '80s, as well as conflicting reports from Obama's family about his place of birth.

Apuzzo told WND the biggest reason to investigate further is the fact that Obama has refused to allow public release of a signed "vault" copy of his original birth certificate (it costs only $12.50 to do that, but he decides to spend nearly a million bucks to have three law firms keep that and other documents under wraps? Something's rotten in Denmark).

Several of the legal cases – including those brought by Orly Taitz, Cort Wrotnowski, Leo Donofrio and Philip Berg, already have been discussed in conference at the U.S. Supreme Court, which has failed to have a hearing on any of the merits involved (guess we may never know now, won't we?).

Taitz, in fact, is requesting information from the Supreme Court about a meeting eight of its justices held with Obama (now what was that all about?), a defendant in her case, before the justices reviewed the issues of the case in a private conference.

Several of the cases still remain active at lower court levels, from which emergency requests to the high court were launched.

"I know that Mr. Obama is not a constitutionally qualified natural born citizen and is ineligible to assume the office of president of the United States," Berg said in a statement on his ObamaCrimes.com website.

"Obama knows he is not 'natural born' as he knows where he was born and he knows he was adopted in Indonesia; Obama is an attorney, Harvard Law grad who taught Constitutional law; Obama knows his candidacy is the largest 'hoax' attempted on the citizens of the United States in over 200 years (attention, mainstream media, don't you smell Pulitzer Prize?); Obama places our Constitution in a 'crisis' situation; and Obama is in a situation where he can be blackmailed by leaders around the world who know Obama is not qualified," (perhaps referring to Vladimir Putin? Controversy continues to surround President-elect Barack Obama's eligibility to serve as president, and a case involving his birth certificate waits for its day before the U.S. Supreme Court. A constitutional lawyer said were it to be discovered that Mr. Obama is not a natural-born U.S. citizen, it would have grave consequences for the nation.

According to the Constitution, a president must be a natural born citizen of the U.S. Mr. Obama's critics have failed to force him legally to produce his original birth certificate, and Mr. Obama has resisted any attempt to make him do so. Currently, only Hawaii Department of Health officials have access to Mr. Obama's original records.

Some of Mr. Obama's critics have said he was born in Kenya and have claimed he is a citizen of Kenya, Indonesia, or even a British subject.

Edwin Vieira, a constitutional lawyer who has practiced for 30 years and holds four degrees from Harvard, said if it were to be discovered Mr. Obama were not eligible for the presidency, it would cause many problems. They would be compounded if his ineligibility were discovered after he had been in office for a period of time.

"Let's assume he wasn't born in the U.S.," Mr. Vieira told The Bulletin. "What's the consequence? He will not be eligible. That means he cannot be elected validly. The people and the Electoral College cannot overcome this and the House of Representatives can't make him president. So what's the next step? He takes the oath of office, and assuming he's aware he's not a citizen, then it's a perjured oath.

Any appointments made by an ineligible president would have to be recalled, and their decisions would be invalidated.

"He may have nominated people to different positions; he may have nominated people to the judicial branch, who may have been confirmed, they may have gone out on xecutive duty and done various things," said Mr. Vieira. "The people that he's put into the judicial branch may have decided cases, and all of that needs to be unzipped."

Mr. Vieira said Obama supporters should be the ones concerned about the case, because Mr. Obama's platform would be discredited it he were forced to step down from the presidency later due to his ineligibility, were it to be discovered.

"Let's say we go a year into this process, and it all turns out to be a flim-flam," said Mr. Vieira. "What's the nation's reaction to that? What's going to be the reaction in the next U.S. election? God knows. It has almost revolutionary consequences, if you think about it."

Mr. Vieira said Mr. Obama's continued silence and avoidance in the release of his birth certificate is an ethical issue because of the dire consequences that could be caused by a possible constitutional crisis.

"If he were my client and this question came up in civil litigation, if there was some reason that his birth status was relevant and the other side wanted him to produce the thing and he said 'no,' I would tell him, 'you have about 15 minutes to produce it or sign the papers necessary to produce the document, or I'm resigning as your attorney," said Mr. Vieira. "I don't think any ethical attorney would go ahead on the basis that his client could produce an objective document in civil litigation [and refused to do so]."

Further, Mr. Vieira cited a fraud ruling in a 1977 case called U.S. v. Prudden, which he feels applies in this case.

"Silence can only be equated with fraud when there is a legal and moral duty to speak or when an inquiry left unanswered would be intentionally misleading," the ruling reads. "We cannot condone this shocking conduct ... If that is the case we hope our message is clear. This sort of deception will not be tolerated and if this is routine it should be corrected immediately."

Mr. Vieira said such an ethical question of representing a client who refused to produce such a basic document is important, even in a small civil case. The current question is concerning the man who potentially could have his finger next to the nuclear button.

"[The birth certificate], in theory, should be there," said Mr. Vieira. "What if it isn't? Who knows, aside from Mr. Obama? Does Russian intelligence know it isn't there? Does Chinese intelligence know it isn't there? Does the CIA know that it isn't there? Who is in a position to blackmail this fellow?" (I can see it all now: Obama offers Hawaii to the Russians provided that the KGB guards his birth certificate around the clock and places roses on his dear grandmother's grave at least twice a week).

Mr. Vieira explained all laws have to be submitted to the president. In the event that there is no valid president, then no laws passed by Congress in that administration would be legally null and void. Because of that, this case will probably not go away, even after Mr. Obama takes the oath of office.

"If you don't produce it, you think it's going to go away," he said. "There are all these cases challenging Mr. Obama, and some challenging secretaries of state, and they run into this doctrine called standing."

Mr. Vieira explained although legal standing is difficult to get around in Federal courts, the document could be produced in any criminal cases stemming from legislation passed in the Obama administration.

"Let's assume that an Obama administration passes some of these controversial pieces of legislation he has been promising to go for, like the FOCA (Freedom of Choice) Act," said Mr. Vieira. "I would assume that some of those surely will have some severe civil or criminal penalties attached to them for violation. You are now the criminal defendant under this statute, which was passed by an Obama Congress and signed by President Obama. Your defense is that is not a statute because Mr. Obama is not the president. You now have a right and I have never heard this challenged, to subpoena in a criminal case, anyone who has relevant evidence relating to your defenses. (Way to go, Joe Schmoe!) And you can subpoena them duces tecum, meaning 'you shall bring with you the documents.' "

Such a criminal defense would enable the defendant to subpoena any person to testify in court and any person to bring evidence in their possession to the court.

Further, records could be subpoenaed directly, in the case of a birth certificate. Once the record could be subpoenaed, the birth certificate could be examined by forensic experts, who would then be able to testify to the document's veracity as expert witnesses. Any movement by the judges to make a special exception to the president in a criminal case would hurt the legitimacy of that presidential administration. (Indeedy!)

"I can't believe I'm the only lawyer who would think of this," said Mr. Vieira (and I can't believe I'm one of the few citizens who think the same). "I think any criminal lawyer defending against one of these politically charged statutes is going to come up with this. That means it will never go away until that document is laid down on the table and people say, 'yes, there it is.' And therefore they're caught. If people keep challenging this and the judges out of fear keep saying 'no, go to jail, go to jail, go to jail' then that's the end of the Obama administration's legitimacy. On the other hand if they open the file and it's not there, then that's really the end of the administration's legitimacy."

Several court cases in the birth certificate controversy are waiting admission to the Supreme Court.

A gathering of judges will meet on Dec. 5 to decide whether or not to hear a case from New Jersey, and a decision is still pending on a case from a lawyer in Pennsylvania. (tick, tock, tick, tock ... ) Should four of the judges vote to hear the case in the Dec. 5 meeting, then it will be scheduled for hearings. Court cases from Connecticut and New York have also applied for hearings at the U.S. Supreme Court.

The flap over Obama's qualification to be president is getting more interesting by the day. There could be riots looming if it turns out he indeed is a usurper to the presidency and hands over the reins to McCain/Palin or gets impeached. Leave it to a smart cookie like Janet Porter to ask the tough questions that the media somehow cannot bring itself to do:

But before I tell you what the experts found, let me ask you a few questions:

1. If you were a natural born American citizen and had it within your means to quiet all the lawsuits and questions with proof, would you do it?

2. If you were a natural born American citizen, would you spend thousands of dollars to fight the legal cases against you, or would you simply answer the legitimate question of whether you meet the constitutional requirements for office?

3. If you were a natural born American citizen, would you forge a document called a "Certification of Live Birth" and tell the public it was a real "birth certificate"?
