        <description>While we wait for the council to emerge from closed session, here&#039;s a quick take on what&#039;s to come (during the first part of the meeting they honored tons of top high school seniors...congratulations scholars!):

Sales tax revenues dropped sharply in the first (calendar) quarter of 2009...by 14 percent, more than the expected 7 percent, compared to the previous year (I have story in works for tomorrow.) The council will hear more about this tonight.
&amp;nbsp;
One thing: that decline is for the current fiscal year, the one ending in less than a week. I&#039;m not sure how it fits into budgeting for the new fiscal year. 
&amp;nbsp;
Also, the decline seems to be sharpening in the current quarter by as much as 23 percent.
&amp;nbsp;
So assumptions about fiscal 09/10 sales tax revenues...a major portion of the general fund...may need to be changed. We&#039;ll see.
&amp;nbsp;
The budget gets passed tonight. Latest word is no layoffs are needed (11 were expected) due to attrition and shuffling. Not sure if that will change with tax decline.
&amp;nbsp;
Also tonight: traffic impact fees. The city council will almost certainly pass these. Any drama, aside from public speeches, will come in the form of a lawsuit.

                <description>&lt;p&gt;Unlike all other major cities and counties in the state, Bakersfield and Kern refuse to become &lt;strong&gt;Self Help&lt;/strong&gt;. I am no fan of many of the developers here in the community who have skated for a long time with &lt;strong&gt;extremely&lt;/strong&gt; low fees compared to other markets. The developers here became addicted to an unsustainable model, which gave them enormous profits up until 2006 when their model collapsed because there was no real glue to hold it. The problem for everyone in the house building industry today who does business from Bakersfield to Sacramento is that the inventory of existing homes in foreclosure makes any construction unnecessary.&amp;nbsp; &lt;/p&gt;
&lt;p&gt;Bakersfield management needs to understand, however, their idea of trying to exclusively tap one industry for all the money needed to come up to state and federal requirements will never get them enough money to make the road projects happen. Not in this lifetime. &lt;/p&gt;
&lt;p&gt;It is always enlightening to drive Highway 99 north through the valley and check the roads and what other communities have done. You will find smooth a multilane freeway through the major cities in the Central Valley that stand in very stark contrast to our battered excuse of highway, which is particularly bad north of the Highway 58/24th Street junction all the way to the southern outskirts of Delano. Curiously, Delano with its big prison population enjoys great highway road conditions. Fresno stands as a model of what should happen when it comes to &lt;strong&gt;Self Help&lt;/strong&gt;. The freeways are always being improved and the interconnectedness of the city showcases what can happen if community leaders and the general population agree on targeted goals. &lt;/p&gt;
&lt;p&gt;Bakersfield is all about selfish interest for the very few who have so much, and the multitudes who have so little. The gap in wealth distribution here makes reaching goal consensus impossible. The poor would prefer to strip away everything they believe they can from those who stand so far above them. The rich continue to talk out of both sides of their mouths when it comes to government- railing against taxes on the one side and then extorting cities for huge tax incentives to do the smallest thing on the other side. So many of the bigger companies here are not even California registered companies. To bypass taxes these pillars of the community incorporate in states where the terms of of incorporation and tax liability are less than California. This has helped to create our current budget crisis, credit crunch and deteriorating infrastructure.&amp;nbsp; &lt;/p&gt;
&lt;p&gt;So the question remains, who is going to step up and pay an equitable share to make something happen for the greater good?&amp;nbsp; &lt;/p&gt;

(They can apply for an extension of a year or so; last night city officials said no one had applied, so a separate matter on the agenda of extending expired rights in those circumstances was moot.)&lt;/p&gt;

Well the failure to pass a fee last night made no sense. &lt;br /&gt;
The ability to vest for 15 or more years makes no sense.&lt;br /&gt;
&lt;br /&gt;
Now consider what will happen if the 13 grand passes on the 15th.&lt;br /&gt;
&lt;br /&gt;
What would stop developers from vesting another 35000 lots for another 15 years at 13 grand?&lt;br /&gt;
&lt;br /&gt;
The impact fee would be&amp;nbsp; perpetually inadequate.&lt;br /&gt;
&lt;br /&gt;
If something is not done about the vesting. The fee must contain a cost of living increase. It would be the only way to have an adequate impact fee.&lt;br /&gt;
&lt;br /&gt;
Also: the idea of attaching a third of the fee to the new home like a mello roos. Is insane.&lt;br /&gt;
&lt;br /&gt;
If I would sell a house and&amp;nbsp; carry a loan on a home that I would own. I would in fact be demoted to that of 2nd mortgage holder. I would be stuck with a bill for a product the original builder should have footed. It is also my understanding that things such of mello roos can not be paid in full after the permit is pulled. After the permit is pulled finance charges/fees and the like apply.&lt;br /&gt;
&lt;br /&gt;
Don&amp;rsquo;t forget. Current Mello Roos in Bakersfield area are subject to the same 2% increase as property taxes. Resale on those homes will be made almost impossible compared to those homes not disabled by such a fee.&lt;br /&gt;
&lt;br /&gt;
I just can&amp;rsquo;t figure out why the council believes a builder should be able to profit from the construction of homes or commercial property. If they can not afford to build the roads and other infrastructure. It would be like Ford building a car that will not run.&lt;br /&gt;
